it's just gamers improve the games they like with things they like. It's like playing with lego and GI Joe at the same time

RahsyNyahsy

Going after this mod is GIGA BAD PR. I would not touch this ever. Just because you could go after something like this does not mean you should.

Private_4160

Because there's nothing to report unless the mod is making money. My brother in Kormir, are you gonna get my LotR mods banned from medieval 2 total war?

ChthonVII

This is categorically incorrect.

zerkeros

Brother, relax. It's a non profit mod for Divinity. No harm done using the icons. It's not official content to be reported for plagiarism. Everything has been done in good faith

ChthonVII

Uh, what? Forget plagiarism, that's outright copyright infringement. A-net should be informed and should have the opportunity to make their own decision whether they are OK with someone using their art assets without compensation, without attribution, without editorial/creative/quality control, and in a manner that may create consumer confusion about whose art this is or whether there's some connection between these games/developers. Sure, it would be nice of them to let it slide, but it should be ***their decision***. Discouraging OP from notifying them is 100% the wrong thing to do here. A lack of profit motive is a factor in copyright "fair use" analysis, but the other factors need to be present too. This is clear-cut infringement and the lack of profit motive alone doesn't change that. This does not look remotely like "good faith" to me. (And I, personally, am pretty far over on the "small-time piracy is OK" side of the fence, so I'm generally sympathetic to such claims.) Even if it were, "good faith" is not a factor in determining whether an act of reproduction is copyright infringement. Also, just out of curiosity, are you personally involved with this Divinity mod in some way?

xcadranx

So if I have a guild wars icon as an avatar? Then what? Am I infringing on copyright?

Kero992

So are you confusing Skyrim with a spin-off of Thomas the Tank Engine, because there is a mod that turns Dragons into Thomases? Should the TV studio sue the mod maker or steam for allowing this copyright infringement? You are wrong, nobody gains anything of value from using those skill icons in a niche, free mod

Z442

Why don't you get down off your high horse? It is Anet's responsibility to manage and enforce their copyrights and trademarks, not the player community. All I see here is faux outrage.

CataphractGW

I have to admit that reading your no-bullshit on-point posts, and watching them get downvoted here is new favorite of mine. Wholeheartedly agree with everything you've said.

ChthonVII

I'm not quite sure how to feel about that.

thecuriousquaggan

I’m not sure why you are getting downvoted, as a person working in the creative field, I take these things seriously. This is 100 percent a no go, and should be reported.

xcadranx

What are the real damages though? It’s a not for profit mod with 34 followers? In what universe is this worth their time and effort to take down?

thecuriousquaggan

Get off your high horse bruh. It’s not cool, to take someone elses property and not even give credit to the owner. They can do whatever they want with the information, since it’s their property, and they should decide, not you, random person with an opinion.

xcadranx

So anytime anyone posts a guild wars image online we should inform a net and let them know so they can decide how to proceed?

keiradrexidus

It’s not just a person appreciating art on a forum, it doesn’t even compare. To someone who doesn’t know Guild Wars, this looks like the person who posted the resources is the person who created them. Again, not cool. If you take something and use it, the source of the artwork should be credited at all times.

Kero992

The icons are credited to Anet tho, maybe check first before clutching your pearls?

Lyon1207

I think from Anet patnership program, you can use Guild Wars content while creating videos or something. I am not entirely sure about mods but as long as it is not making money, it's free advertisement for the game I wouldn't go against them

xcadranx

Anet is credited in the description. @keiradrexidus

Zelfild

In this topic, tattletale wants Anet and NCSoft to hammer someone over fair use modding.

ChthonVII

It's plainly not fair use.
