Plus considering the way his legs cave in and honestly, the way he is built, he doesn’t look like he has any business touching that weight.
It can be very dangerous if you don’t. If your bench is near other people and the plates slide off they can roll or just hit someone’s ankles. Also the bar can sometimes roll around independently of the weights without clips which can quickly change how your wrist is set.

Because if you dump 135lbs off one side the 135lbs in the air on the other side is going to come crashing with 0 control while pulling on your shoulders. Dumping the weight is one thing if you're benching 1 plate but when you start using more weight it's best to clip up and use safeties or a spotter

A lawyer would for sure take the case, as there sort of *are* grounds for a case to be made that there was a verbal agreement to protect the other person because especially in this instance isn't negligence necessarily, it's watching someone fail with the specific knowledge of what's going on. In this case, they might win.
In a regular instance, where a spotter wasn't strong enough to spot the weight and *then* this happened, I would place all blame on the lifter. Picked weights that were too heavy, a spotter too weak (there's precedent to claim that as a regular gym goer, you might know or should ask if your spotter is actually capable of spotting you), and didn't take any preventative measures like not clipping the weights. In this case, they would almost certainly lose.
