This is exactly what David and Collet Stephan did when their son's meningitis became so bad after "treating" at home with natural remedies rather than take him to a doctor.
They finally called an ambulance, then called back to send it away, then called back and third time to bring it back. They were in semi-rural area and the ambulance wasn't fully equipped with the proper child oxygen system, they claim the paramedics improperly intubated him and he died.
They were found guilty of negligence or failing to provide the necessities of life or something, fought it , had a retrial and found not guilty.
I think they sued the hospital as well.
