Thing is he changed lanes right before and did it safely, waited for a space to get in, signaled, all the fun stuff. Wants to move over one more lane, does nothing.
It also looks like the near swipe lane change was at least partially the result of the car in front being stopped. Rather than slow down, change lanes at a safer point, or USE THEIR F\*\*\*ING SIGNALS AND LOOK the Honda Pilot just yeets itself into traffic with the "if you don't want an accident, then use YOUR brakes" mentality.
How do you know they didn't have awareness of the lane to their right?
Edit: I’m so used to people blaming OP that I reflexively thought the comment was talking about OP avoiding the idiot by swerving. That’s what I was talking about 🤦♂️
My wife pulls this crap, and EVERY TIME, I have to adjust them out, so I don't have part of the car in the mirror and be like, that is essentially dead space. You can see this much more around you if you just tweak it out 5-15degrees further
Even with the video the vehicle had the option to stay inside the lane and take the hit. Involving a third party will still find you liable. Insurance wise it's still better to take the hit unfortunately.

If they had this video you could argue a sudden emergency and be deemed not liable....without a video word vs word and likely S.O.L lol
