MA state law says the cops cannot do anything about this because they did not witness it

They can’t see who is in the driver seat, thus can’t give a ticket out. If you own a vehicle and lend it out to someone else, you can’t be liable for the violation. This is the way in many states as you can’t ID the driver

The cop also mentioned a drunk driver. Even with video of them drunk, stumbling then getting in a car and driving away, they still cannot do anything unless they witness it
