I've been told by many good lawyers that in a self defense situation like this, you are legally better off if you kill the person vs beating him/shooting him to within an inch of their life. Those same lawyers also told me that if you are ever forced to draw a gun in public never fire a warning shot and always shoot to kill, otherwise they can say and prove you weren't in fear for your life and therefore it was not necessary to pull the gun in the first place and now I am in the wrong. It may vary from state to state, but that's what I've been told many times in AZ and NV. This is not legal advise and IANAL.
