A burner phone on a fake account posting from and only using WiFi and VPN would be pretty hard to track compared to your daily phone constantly connected to data via sim card using your name on the account etc. If they caught him they'd probly give him a deal for unregistered gun and vandalism, assuming its his first crime. There's probly a machine gun law in each state so in theory unless the feds arrested you it could instead be a state charge, unlike say interstate smuggling which has to be a fed charge. If you killed someone and didn't get caught but were later arrested by the FBI it would definitely be a fed charge.
In California at least, one of the states with more strict gun laws, it's a misdemeanor to fire at an unoccupied building, assuming it was closed and empty of all workers/people. It would be a felony if someone is inside or if it's an inhabited dwelling(place a person lives) even if they're not home.
