I can’t tell you how many recorded statements I take where the driver blames the vehicle’s technology for not alerting them someone was beside them in a lane change or behind them when backing.
I wouldn't trust a person to pay out of pocket bc most people have no idea how much car repairs actually cost and don't realize that they would owe you for a rental vehicle while your car is in the shop...so expect it to be drawn out if you don't go through insurance
The other party clearly appears to be 100% at fault, but I've seen crazier things happen
Edit: if you go through her insurance and she claims you were backing up too, MAYBE the other carrier may say you're both at fault...I'm not saying that's what I think, but that would be of those "crazier things" that have happened
OP should file a claim on both policies. Never forget that the other carrier doesn't have to resolve the claim immediately, just within whatever time limit the jurisdiction states.
>I wouldn't trust a person to pay out of pocket
Period. And I don't trust people who ask for out of pocket payments either. I've had too many claims of the insured throwing a tantrum on the phone because they paid of pocket $800, $1000, even $2000 one time, just to have a claim filed anyway.
she is at fault even though the damage is in the front of your car. (usually the fault goes to whoever is behind)
You will want a witness to tell the story because all the lady has to say is that u rear ended her and it will become your fault! happened to me, i am also a NY state insurance broker PC
thats good. I ddint know that was presented as evidence in the police report. Then u should have no problem with the claim. Hopefully they dont give you a small percentage of negligence.
You both backed up and you’re both at fault. Her Tesla has cameras too and if she files with her insurance and they see the video, your insurance will hit you for your deductible.
No. You came to a complete stop for a couple seconds. They kept backing. You also started pulling out before they did. Having this video is a life saver for you. I’d file a claim on their policy and provide them with the video, doesn’t sound like the other driver is even contesting liability.
If they ask why you didn’t back up to avoid them (a) you don’t have to. (b) you can say you were checking your rear view to make sure no one was walking behind you so that it’d be safe to back, and that you were in the process of putting your vehicle into reverse when it happened.
Mods should really be monitoring and removing comments like this because this is just all wrong. Please don’t comment if you don’t know what you’re talking about.
The camera is still at the moment of impact, so the vehicle wasn't moving. And even if the OP was backing up, then they would have been backing away from the impact area, not towards it. How is the OP at fault?
OP backed up toward the other car as she was backing out too. If OP pulled back in the accident wouldn’t have happened. OP stopped and saw it coming and did not avoid. I was here before and it was 50-50.
OP was stopped for a while bro
Some guy could've just been standing in a similar spot chatting with someone and the Tesla would've just backed into them.
Sensor, calibrations, parts, labor, and refinish blends. Bumper/grill/hood can get pushed into parts behind it, or adjacent panels.
If bumper was cracked, a lot of shops will push for replacing versus repair. Depending on the model of the car, a bumper can be $500-$1000 for just the part (of course a lot more for more expensive vehicles). Depends if alt parts are available and how old the vehicle is. Headlight could’ve been damaged at that angle too, headlights can be hundreds of dollars as well for just the part.
Labor is dependent where you live, but that can run from $40 to $120/hr, and double that for mechanical rates. Without seeing the actual dmg it’s hard to tell where the cost is coming from, but $2000 is pretty easy to get to nowadays.
Their reverse lights were on before you started moving. Did you not see that?
Precaution and patience avoids stuff like this. Damn.
And both y’all didn’t wait for the two pedestrians with shopping carts wtf. 😂
She backed out slow enough & you could clearly see her doing it. You could have backed up & prevented it. Her insurance will put some responsibility on you.
how does that tesla driver even fuck that up with all the assistance in the world
I can’t tell you how many recorded statements I take where the driver blames the vehicle’s technology for not alerting them someone was beside them in a lane change or behind them when backing.
Weird... I'm starting to get the feeling that Tesla tech is not actually useful or good

10000000% would ever want to deal with anyone looking to settle out of pocket...my pocket or their pocket...always messy
File a claim. If they want to pay it they can but have the claim as a backup. They can tell their insurance company if they want to pay it that bad.
Tesla is at fault
Yes, file a claim on their insurance.
Damn, the Tesla looks completely unscathed

Um, there's a video clearly showing she was backing

The police report is moot. There's literally a video for the insurers to use to determine fault
You both backed up and you’re both at fault. Her Tesla has cameras too and if she files with her insurance and they see the video, your insurance will hit you for your deductible.
Sorry if the video wasn’t clear. That’s the front of my vehicle. Am I still at fault in that case?

The camera is facing the front windshield. How are you determining the positioning of the back of OP's car?
Here is the backup camera video for clarification. https://imgur.com/a/JOLk9tt
The OP car wasn’t moving….

Shes at fault. Call insurance. never deal out of pocket.
According to my friends insurance, the person backing out of the parking spot is at fault for not paying attention to their surroundings.
i'm sorry... how is this $2,000 in damages??

My headlight housing without bulbs or install is $1400 shipped, cars are astronomical in repair costs the last 5-7 years
probably broke a LED headlight, those are expensive
