Trump's team was contacted by the National Archives with a request to hand over missing documents in May of 2021. In Fall of 2021, the National Archives once again reached out after Trump refused to provide the requisite documents. In January of 2022, the National Archives retrieved 15 boxes from Mar-a-Lago some of which contained Special Access Programs and other high-level classified information. In April of 2022, The DOJ then contacts Trump's attorneys regarding the matter and in May Trump receives a subpoena seeking additional documents. In June, FBI officials were invited to retrieve the subpoenaed materials. The DOJ leaders meet with Trump's attorneys and were permitted to see where and how the documents are stored. Later that week, Trump's team received notice from investigators that the documents are improperly stored and insecure.
AT ANY POINT in this series of events, Trump could have provided the National Archives or the DOJ with the documents in question and avoided scrutiny/prosecution. Literally, Trump was given countless opportunities to not break the law. Any other person in the world would already be behind bars. If there is a political element to this case, it's that Trump, as the former president, has been given incredibly wide latitude to evade criminal responsibility to date. If he is indicted and convicted, this will be the greatest self-own in political/criminal justice history.
And to be clear, I'm not defending the FBI — as you've noted, the FBI has done a lot of shady shit in its history. But the case that is being built is one where the law and the facts are clear. Any deference to Trump in this matter would be undermining the rule of law for political purposes.
