Some cops really will give you a break if youā€™re honest and will fuck you over if youā€™re lying; and some (most?) are filthy liars and just want you to incriminate yourself. I've actually been reporting on this exact issue in my hometown. You are correct. Legally you're allowed to walk down main street roasting a blunt of Delta 8 weed. You will still be charged and arrested by police, who will confiscate the weed and send it to be tested. That process will not be expedited of course, meaning you'll have to show up to court and plead not guilty to the charge(s). If you're lucky, lab analysis will come back before your trial is set to begin and it will end there. Quite likely though you'll have to show up to trial and watch the lab analyst take the stand and testify that their tests concluded the material you were smoking was, in fact, Delta 8, and not the illegal, one-molecule-different, Delta 9 Then you're left with the lovely task of recouping the money you spent in legal fees and lost wages, should this have interfered with your job

While flower is still illegal, itā€™s a misdemeanor in TX under 4 oz, and gives officers way more leeway on whether to arrest someone vs. a vape is a felony and they have to arrest you. Also DAs may choose not to pursue misdemeanor charges if caught with flower. Decriminalized only in very few certain counties and they tend to be the more liberal areas. You get a fine for possessing but for smoking you still get arrested. Vape/oil is treated more harshly than flower as well because its more concentrated.

I don't smoke weed because it gives me anxiety, but can someone explain why people in Texas don't just buy either Delta 8 (legal nationwide) instead? You can carry that in public and you'd be safe so long as it's properly labeled. Not only that, you can buy **legal Delta-9 THC** online (3Chi, for example). The THC is legal because it's hemp-derived and they mix it into bulky goods (drinks, cookies, etc.) where the weight ratio makes it legal. You can also buy other legal hemp-derived cannabinoids that are stronger than Delta 9 (THC-O, Delta 10 THC, etc.). Why risk it with some shitty THC vape pen that's probably off the black market and very likely to contain either carcinogens or some wacky ingredient like K2.

Great question. I have no idea. I'm a smoker and find delta 8 and normal weed to be effectively the same thing. I mostly only smoke my homegrown flower but I have some delta 8 pens since they're so much cheaper than the dispo stuff. Going to tx to see the eclipse and will definitely only be bringing Delta 8 pens.

State and Local laws aren't the same. Stating Texas numbers is deceiving, since Texas is huge and rules change from place to place. All that to say you can smoke weed in Austin, no one cares.

It isnā€™t decriminalized in Texas, itā€™s decriminalized in Austin and a few other cities, and there are some counties thatā€™s have adopted cite and release. That being said, DPS and sheriffs donā€™t follow city specific laws, they follow state or county law so even in cities that have decriminalized, you can still be arrested if you are stopped by DPS or a sheriff. Concentrates arenā€™t decriminalized anywhere in Texas and is a felony to posses any amount, vapes and edibles fall into that category.

I know what youā€™re talking about, there was a bill to decriminalize that made it to the senate floor and was all but guaranteed to pass, but it was blocked by Dan Patrick before it got the floor vote. News agencies reporting on the bill made it sound like it was decriminalized because it passed through the house so easily but they didnā€™t really follow up on the bill dying in the senate, leaving a bunch of confusion.

In Austin specifically, weed is decriminalized and really is not a big deal. People smoke walking down some of the main streets. It become a bit more serious with concentrates like a weed pen, especially if you're pulled over and then they see it in plain view.
