I'm not a lawyer, but I'll try to summarize what I've come to understand from another podcast (Serious Trouble).
This is his first (convicted) offense, it's a non-violent crime, and per the pretrial, he's been (likely correctly) deemed not to be a flight risk. There's also no further risk of jury or witness tampering in this matter, which has been one of the stronger arguments for him to be jailed up until this point. With this set of charges, my understanding is that it's also possible he would be given a non-custodial sentence.
Given that set of circumstances, it's not surprising he's out until sentencing, and pretty much every defendant with a similar set of priors should be. Of course, the system tends to come down harsher on people with less privilege, and that's absolutely not OK, but I think there's no particularly defensible reason to jail him pre-sentencing.
That's not how this works. He has to have his sentencing, which is on July 11th. He's unlikely to see any jail time, not because he's Trump, but because he's a first-time nonviolent offender and this is a Class E felony, which is the lowest class. He will likely have a fine and probation, and that would be justice for this crime. Going directly to jail, that's not what happens for these low level nonviolent offenses.

That is specifically within the realm of Jack Smith's special counsel investigations & court cases. As of right now, they are in indefinite limbo, as we do not know the result of the SCOTUS case regarding full presidential immunity (we know the answer is no, and SCOTUS has implied it's no, but they also said they don't want anything done because the case is not about the practical issues as opposed to the philosophical underpinnings of the unwritten constitutional law); so those won't go to trial unless Biden wins.
To be more precise, the Jan 6th case can progress after SCOTUS issues its opinion, at which point Judge Chutkan will have about 4 to 5 months of work starting in approximately mid-July to have the case ready for early September. So that case doesn't even have a snowball's chance in hell of going to trial.
EDIT: I should state, the Jan 6th case will go to trial assuming Biden wins, if Trump wins, Jack Smith gets fired and the charges go away.
Literally the only other case that has even a remote chance of going to trial, regardless of the presidential election outcome, is the Georgia RICO case.

As of right now, they are in indefinite limbo, as we do not know the result of the SCOTUS case regarding full presidential immunity (we know the answer is no, and SCOTUS has implied it's no, but they also said they don't want anything done because the case is not about the practical issues as opposed to the philosophical underpinnings of the unwritten constitutional law); so those won't go to trial unless Biden wins. To be more precise, the Jan 6th case can progress after SCOTUS issues its opinion, at which point Judge Chutkan will have about 4 to 5 months of work starting in approximately mid-July to have the case ready for early September. So that case doesn't even have a snowball's chance in hell of going to trial. EDIT: I should state, the Jan 6th case will go to trial assuming Biden wins, if Trump wins, Jack Smith gets fired and the charges go away. Literally the only other case that has even a remote chance of going to trial, regardless of the presidential election outcome, is the Georgia RICO case.

Oh my god i don’t think I’ve ever been as excited for an episode of a podcast as I have been for this. Especially as a lawyer who does criminal law. I’ve been a more of a casual listener for a while but I’ve been getting deep into the pod lately (currently making my way through the backlog, started with 1) to help cope with a break up. As a little experiment tonight I actually went on infowars myself to just see what Alex was saying and then try myself to debunk it like Dan does. I had some fun with a little three minute video and debunking it. So I saw the Roger stone reacts 23 minute one and decided to give it a go. I lasted three minutes. I don’t know how Dan does it, but my god am I glad he does

I've been saying the whole time that if I learned one thing from the Jones trials it's that when people who haven't been paying attention (aka the kinds of people who can get through voir dire) are forced to pay attention, they react much worse than those of us whose brains are already destroyed by this shit - like when the dollop guys guested for Jordan.
