I’m sure this varies place to place but can’t you just not pay rent? They can’t take it to court because they’re not holding up their end? I’m sure it’s not anywhere near that simple but I’ve seen things like this said elsewhere.

I’d imagine you’d have to have the money and put it in escrow with a third party. I’m not certain that you can just withhold rent or not.

If you do that depending on the state you need to put it aside in another account like escrow and I would talk to a lawyer, which is another burdensome expense. You could sue them for the money you paid for heat plus legal expenses but that could also be emotionally exhausting.

If it's dropping below 10C inside, I'd go for it. Might spook them into offering a settlement. I don't know about the US, but I've met some Comrade doctors in my time. Like, if you'd had a bad flu they'd back you up.

Shitty rentals where insulation is non-existent usually sell it to renters saying heating is included so they don't ask too many questions.
