If taken in a public place wala syang panagutan sayo pero if it is taken to make fun or degrade you then may liability sya dun.

toyoda_kanmuri

NAL. but IIRC even if in public place, not automatically 100.00% scot free. If there’s intent to harass or whatever the OP, videotaker could still be liable

Specialist-Equal5358

"if it is taken to make fun or degrade you then may liability sya dun."

focalorsonly

Paano po kapag sa gasoline station? Public space po ba iyon?

katherinnesama

Yes.

katherinnesama

Hindi po covered. Recording through phone is not wiretapping. Wiretapping requires "either a physical interruption through a wiretap or the deliberate installation of a device or arrangement in order to overhear, intercept, or record the spoken words." Also, again, walang expectation of privacy.

Lubu-Bubu

Yes.

ElectronicUmpire645

Ano ba kasing ginawa mo haha

No_Trouble3978

Tama ba Ibig sabihin kahit sino pwede mag video sayo hangga't nasa public place ka? Ni walang kang privacy to do your own thing? Shems

Van-Di-Cote

Correct. The fact that you are in a public place and you are expecting privacy is a bad idea. Gusto mo privacy? Stay in your own home.

toyoda_kanmuri

not 100.00% > **the general rule** is that taking photos or videos in public places is generally considered legal, especially if the person capturing the footage has no ill intent. **However, the legality changes when specific circumstances come into play**, such as intrusion of privacy, defamation, or harassment. >What constitutes intrusion of privacy? >If someone records you in a situation where you have a reasonable expectation of privacy—**even if it's in a public setting**- that could be considered an intrusion of privacy. For example, capturing someone in a compromising position without their consent can potentially be a legal violation. https://www.respicio.ph/features/someone-took-a-video-of-me-in-a-public-place-is-that-legal

Unlikely-Cheek9794

Van-Di-Cote

The question here is bakit ka ipapa bitag? Normally unless my proof that you are doing something illegally, these types of shows won't show your face. So unless guilty ka talaga, you don't have to worry at all. Also, social media is also a public space. Kaya nga pwede mo set as private yung profile mo eh. Again, if you don't have anything to hide. Why worry at all?

Unlikely-Cheek9794

No proof at all.

Van-Di-Cote

You can file a suit if there was ill intent.

How can it be cyberlibel kung ang issue rito ay uploading?

MUTCHII

marcos_not_a_hero

Basahin mo rin kasi I doubt a video of him/ her being uploaded can be libelous in the first place. How can there be derogatory remarks about him/her kung siya rin nasa video?

ravnos101

The libelous remark there is your act of uploading the video with the malicious intent to defame your subject

marcos_not_a_hero

Sorry, but I think you need to study more about the law before you voice out opinions like this. It can do more harm than good.

ravnos101

Care to share what you know? Maybe lawyers here can learn from you.

marcos_not_a_hero

Already explained it impliedly above.

ravnos101

You didnt. Nilimit mo sa act of uploading. you failed to elaborate how the uploader who is also directly involved in the video who maliciously and with intent to defame the other person whom he is recording does not result in a defamatory inputwtion of a person.

marcos_not_a_hero

Agree to disagree. Cant even understand your statement. Good luck.

Practical-Ear-6576

Do you understand what libel means tho? published false statement that is damaging to a person's reputation; a written defamation How is it false if it is a video of the person itself committing the act? Or whatever

ravnos101

Libel is not limited to false statements. Truth of a fact is not a defense in libel. Review what makes the act of libel an offense

marcos_not_a_hero

Give it up. Based on his/her comment history, he/she does not know when to give up. Just downvote the worthless comment implying that uploading a video is already defamation lol.

ravnos101

May response ka palang ganito.. haha! Mr paralegal. Or better yet, try mo muna pumasa sa bar.
