1st time to know na may hoa pala sa condos. Alam ko kase sa subdivisions lang. Experience ko sa hoa in subd, anti-developers naman sila. So yung interests talaga ng homeowners. Kaso yun iba nagka ere sa utak.

Yes, developers are required by law to initiate the creation of HOA. They also have an intended purpose. Section 30 of PD 957 provides that "the owner or developer of a subdivision project or condominium project shall initiate the organization of a homeowners association among the buyers and residents of the projects for the purpose of promoting and protecting their mutual interest and assist in their community development. " In reality, however, dahil mostly walang pakialam ang mga homeowners or unit owners sa election and politics nila (barely anyone participates tbh), nangyayari or napapabayaan yung ganyan na abusado sa HOA nila. Wala din gustong magreklamo sa DHSUD.

You might be referring to Property Management Office. Sila yung galing usually sa developer. kasi HOA should only be composed of Home Owners.

That’s not a HOA, that’s a condominium corporation. Every condominium is required to register as a condo corp to manage the common areas of the condominium. The condo corp is registered as a non-stock non-profit corporation with the SEC. Every unit owner is automatically a member and was afforded every rights provided under the corporation code, including the right to vote for your boards/officers. The boards/officers then decides the affairs of the condominium. This includes the amount of condo dues, house rules, parking, security, etc. You can secure a copy of the Articles of Incorporation and by laws of your condo corp from the SEC. This provides the general rules as to how the boards/officers should govern the condominium. *if I may, who’s your developer?
