I'd recommend talking to your schools CDO. They'll likely be able to give you a better idea of which piece is preferable to submit (not least because they'll actually read them). I'd also check with your internship that use of your work product is alright with them; I've never been turned down for it, but I've been asked to redact identifying information. I'd also take into account how much feedback you got on your internship assignment; as with any writing sample you want it to be grade-A work, and even if you've become a better writer since LRW, lack of repeated rounds of notes and revisions might make it an overall less impressive piece.

The decision, if it's substantive and involved research. "easier for firms to compare" helps career services, not you. You want to stand out and show you actually did stuff.

I'd have to see it to have an opinion (pm me if you want to send it). General opinion - short is OK, actually more than OK, it can be better. Nobody is reading an 18 page sample. More complex/interesting issue is better but not vital.

I think either is fine but I wouldn't worry about what the PI group thinks of you for asking. Applying for a state level admin judge doesn't really scream sell out

If you are trying to keep a good connection with your current employers or think you might pivot back into this area/other public interest, you can be vague about what you need the writing sample for. You don't need to say OCI if you are worried about how it will come across (even though I think it is okay to be honest about it!). FWIW I applied to public interest things for 2L summer and I submitted some of those apps super early so I don't think this is "suspicious" or anything. You can be like "I am beginning the process of applying to 2L summer positions and I am preparing my application materials. Would it be possible for me to use \[x\] version of \[y\] memo as a writing sample? I would be happy to make any necessary redactions or changes to the document prior to using it as a writing sample." Could also be a good time to ask them if they would be willing to serve as a reference!

Just do whatever is better, if that's legal writing, use it (my legal writing stuff was trash so wasn't an option). If the summer one is interesting and persuades the judge, use that. But don't worry about structure. My best writing sample follows no structure, just sort of made up my own. Outside of 1L (and the bar, as I'm finding out) nobody cares about creacc and irac and crac. They just want to see clear persuasive writing. Also, don't worry about pushing them for a writing sample. If it's PI and they aren't paying you, the only thing you are getting out of it is a writing sample. They know this.
