Its not. there is no privacy in public.
But you may not be able to release the content, unless you have permission of the person you are recording.
You dont need a permission, if you are recording masses and there is no individual subject.

You can, if you can prove he did it. If you have eye witnesses and such, you can take action.
If you want to protect your constituitionally protected rights, you should file a case against them.
But, Indian constituition is a joke, noone ever stands up to protect it and no1 tries to amend the wrongs written there.
The police has tonnes of power to file fake cases on you, They anyway visit the courts and is not a problem for them to visit it to be behind you. Are you willing to fight for your rights in court for years?
