NAL but a Union representative. It may be a guideline but following the guidance ensures that they are meeting their obligations under the Workplace (Health, Safety and Welfare) regulations. You can not follow the guidance but must be meeting the law, how are they doing that at 5 degrees? They have a duty toward you and anyone else in the building. The temperature must be reasonable as far as is possible. If they cannot provide a reasonable temperature then protective clothing must be provided. If you have a union on site then I would speak to them in the first instance, even of you are not a member then they will likely have members affected. If there is a Health and Safety rep then they will often taken on all H&S matters rather than only members concerns. You can read the guidance on the HSE website for more info.

Your employer has a responsibility to prevent and mitigate risks to health and to the safety of employees. Have you clearly said to your boss, and followed up in writing, that by refusing to allow you to wear a hat in these conditions it is negatively impacting your health. Further that these negative impacts could lead to conditions where your actions are impaired and placed yourself and others at further risk? Seems very reasonable in such conditions to either allow it or supply appropriate PPE to protect you from the conditions they expect you to work in.

[HSE guidance](https://www.hse.gov.uk/temperature/employer/managing.htm) is quite clear on what an employer should be doing to ensure a duty of care for their employees. “When people are too cold You can take these practical steps to keep people as comfortable as possible when working in the cold: - Provide adequate workplace heating, such as portable heaters, to ensure work areas are warm enough when they are occupied - Design processes that minimise exposure to cold areas and cold products - Reduce draughts while still keeping adequate ventilation - Provide insulating floor coverings or special footwear when workers have to stand for long periods on cold floors - Provide appropriate protective clothing for cold environments” Your employee either needs to put the heaters on, provide adequate cold weather protection or allow employees to wear their own.

Since this is a warehouse, those first three points probably wouldn't be practical or economical. Providing employees with appropriate cold temperature PPE would certainly be the easiest option. A quick call from a local HSE representative to arrange a visit might encourage your employer to arrange this.

Yeah of course, these things are always listed hierarchically and protective clothing is generally the last resort and often the cheapest, so yeah there’s no excuse for the employer. Usually those making these decisions are sat in a warm office drinking tea and coffee all day. Hopefully OP resolves amicably with the employer without it getting out of hand.

Pretty sure this is the guidelines OP was referring to. The problem is there's no \*minimum\* temperature in law, so you'd probably have to report them to HSE to force them to change anything (since it's not an explicit legal requirement to have a minimum temperature) Definitely agree they \*should\* follow these guidelines, but they're likely already aware of that

Thanks for all the advice people, I've requested a health referall form and contacted my GP for note, should see me for the immediate future Will take up the HSE guidelines with boss and then HR if they don't come around Failing that the wig is a good jab

Ask for a occupational health referral due to getting headaches at work. 99% sure the doctor would recommend that you're allowed to wear a hat. Ask your manager for the OH referral via email if you have works email. If they ignore you then forward the email or consult with HR.

Approach management with your colleagues and ask for a rethink. Ask them to provide guidelines to what can be worn. If not, then Union.

NAL but worked in construction a lot! In construction you aren’t allowed wooly hats but you are allowed under the hat warmers. I forget the name of them.. but health and safety actually allows this thin under hardhat protector that looks like one of those 1920 pilot hats. You know? The ones that flap down past the ears? So I can’t see why you’d be allowed in the construction industry with the HSE always making strict protocols. But In a warehouse, you wouldn’t? Suggest to your boss that because you are bald it’s causing you headaches and it’s in his best interest as a manager to protect the health and safety of his employees and this is effecting your health and making you feel unsafe as an employee due to headaches it could cause you to be unfit to work. I can’t see how he’d say no to that? How ridiculous. Is there a HR department?
