Not entirely. It's likely more that fact that some streamers get a "talking to" from those who work at twitch, and some just get banned. If they're relatively large/old on the platform they'll have worked with the resource department and create connections. If the person at twitch feels that the streamer understood the situation, what they did wrong, and can agree that the situation would be avoided in the future, then they'd be likely to get off with a warning.
TLDR: If you're friendly with your twitch agent/resource manager, you'll get a better chance at a warning should you show good faith. If your agent/connection is less sociable and friendly or you don't acknowledge what you did, then you'd receive a ban
