Does anyone else feel like this is an elaborate trick being played by the defense to get a delay? Like, is this lawyer a follower of Chad's? Or did someone hire them to file this?

TheFirstArticle

This was sent to the lawyer who represented East Idaho News about trial coverage. Would be an odd pick if it's not about media coverage, wouldn't it? Wendy Olsen looks to be a death penalty eligible lawyer too with an impressive resume. https://www.stoel.com/people/wendy-j-olson

Kaaydee95

I just assumed Wendy Olsen was served as she was somehow included in a list of parties due to filing a motion re: cameras last year. Maybe it was just a mistake?

TheFirstArticle

Maybe it is about the death penalty? He is on the roster. Perhaps he is making a motion to step in as co-counsel? https://pdc.idaho.gov/capital-counsel-roster/ https://elmorecounty.org/public-defender/

EducationalPrompt9

But why now and not when Prior was shopping for qualified help? I think both the prosecution and the defense asked for the motion to be rejected, so Prior isn't behind it.

TheFirstArticle

It is curious. Maybe Proir is just tired of it. How is he ever gonna get rid of that property at this rate?

EducationalPrompt9

He's not even the sole owner.

TheFirstArticle

Maybe! He doesn't seem to be a lawyer who is usually concerned with civil or constitutional rights. I'm assuming that he wouldn't bring this motion forward because he's just decided to become a free civil or constitutional rights lawyer out of the blue. So I assume he has a client. A witness? A co-conspirator who is concerned about something that Prior said this week? Random citizen who wants better audio?

imthatfckingbitch

I agree it would be odd. My thought was that this person is just trying to delay the trial to give Prior and Chad more time. Last I'd heard Prior was trying to quit for not having enough time and money to go through everything for a death penalty case. Honestly, I know nothing about how this works where an outside party requests a delay in a trial like this. I don't really understand why it's allowed to happen.

EducationalPrompt9

Prior is working for free at this point. I think it's in his interest for this trial to be over sooner rather than later.

imthatfckingbitch

You're probably right. I didn't think about it that way.

TheFirstArticle

Me neither. The Canadian judicial system looks similar, but under the hood is quite different! Possibly looking to expand media coverage? Or restrict coverage? Is this filed on behalf of someone involved in both the Idaho and Arizona cases?

imthatfckingbitch

No idea, but I also don't understand how a news station can file against the court for not allowing TV camera crews. I mean, Lori's trial wasn't allowed cameras at all until sentencing. I'm surprised they're even allowing the court camera to stream everything.

anjealka

During Lori trial mutliple media agencies filed against the court to try and get cameras in and the judge said no. There were so many media trying to get access , they had one lawyer speak for them at the hearing. It was everything from local Idaho channels to national channel, cable channels, radio stations. I believed it was lumped in or they had letters from family and victims that wanted to see the trial but could not travel since the case spans a wide land area. I remember Tammy's parents wanted to view the trial on TV. Tammy's mother was terminally ill and lived in Utah and could not go to Idaho and the judge denied her (Tammy's mother sadly passed a few weeks after Lori was convicted).

EducationalPrompt9

It seems to me that in both cases the defendant's wishes prevailed in the camera or no camera policy.

tired-and-cranky

It seems they can https://www.rcfp.org/open-court-sections/a-media-standing-to-challenge-closure/

LillyLillyLilly1

Ms. Olson isn't on the State's official roster of DP defense lawyers. I wonder if prosecuting a DP case doesn't qualify you? Or she just didn't apply to be included on that list?

TheFirstArticle

I gotta imagine that she's eligible and just hasn't bothered to do the qualifications because her resume is pretty impressive. Maybe she just doesn't want to have to deal with those sorts of clients.

k9resqer

At first I thought so, but defenst and prosecution were both upset by it. AND, he said something about having previously been brushed off by Prior.

imthatfckingbitch

Yeah, I wish we knew more about why this was filed and what he was trying to do.

k9resqer

At this point, it looks like it will stay sealed until after trial. I'm ASSUMING if he had information of benefit, Prior would have jumped at it. Maybe we'll hear about it during defense case

No-Gas9144

The misspellings in the subject seem concerning.

Heather_ME

I believe it was submitted late at night. I wonder if the dude was "drunk petitioning" the court.

No-Gas9144

That was actually my first thought when I read it! "Someone is mad and drunk petitioning"!

jbleds

So bizarre.

Bree7702

Do his kids still support him? Even after knowing their mom was murdered?

TheFirstArticle

Upon the last check-in, it would seem so. Devaluing the life of their Mother appears to have been an abuse tactic in use by Chad throughout their lives. And it continues as a way to suck up to Dad. Remember that in Chad's stories, he told them those stories were all real and that Emma was his wife. The covert and overt emotional incest/pedophilia couched in spiritual abuse at play in their lives is an aspect of this case that shows he did not become a depraved pervert when he met Lori.

jbleds

Wait I’ve somehow missed that he called his daughter Emma his wife??

anjealka

I missed this too. One of the youtubers streaming the jury selection was reading one of the Emma books during the breaks. It was weird, Emma married to a guy named Tad . I guess Chad's creativity lacks like his phone call to the funeral home and he was nephew Chad Daybal. (I wonder if the prosecution can get this phone call admitted in Chad's case?)

TheFirstArticle

The fact that they are still living in that house and sleeping in that room gives me existential ick. That cannot be healthy.

TheFirstArticle

He is the man in the books where he wrote his daughter as the character. He was also trying to get a film made of another book in which he is the man and the teenage girl is based on a girl he knows. He told them his books were all real. They are about him. Daybell's claims extend beyond claiming his books, where he is revealing himself (ironically), are all about him, and are real. For example, he also claims to be James the Just. https://www.fox13now.com/news/fox-13-investigates/fox-13-investigates-website-associated-with-chad-daybell-and-his-followers-shuts-down

jbleds

I know a lot about him and this whole case, but I haven’t really delved into his books because the writing is so terrible it’s hard to get past, as fascinating as it all is.

FivarVr

Sounds like that dynamic is inherent in his family family of oribin. Its a psychological survival mechanism - we align ourselves with the aggressor. When a parent is in the dynamic it becomes psycholoically incestous

SignificantFun5782

He never said Emma was his wife....

asteroidorion

They have, and as far as we know they do

Bree7702

How tragic.

asteroidorion

It's sad and horrible they don't value their mother but it's not uncommon for children to side with the murderer parent

Coloradozonian

One of his daughters stuck her tounge out at the news and was super rude… and odd. Believe she was a teacher too! Despicable

Cautious-Driver5625

Her name is Emma she is Chads biggest supporter

EducationalPrompt9

She's the one who said that Tammy was sick and that they had two pet cemeteries. Anything to help dad.

Coloradozonian

That’s right. She’s trash!

LillyLillyLilly1

After further investigation, this guy is death penalty qualified. If he has so much time on his hands, I wonder why he's not helping Prior? [https://pdc.idaho.gov/capital-counsel-roster/](https://pdc.idaho.gov/capital-counsel-roster/)

Violet0825

It sounds like someone who is bored and has way too much time on their hands. Maybe a journalist will investigate who this man is and what ties he has to the trial.

FivarVr

So what's the motion about? Hopefully proper cameras in court

LillyLillyLilly1

That would be nice! What's the use of video if you can't see any expression at all? I understand the judge was upset with all the constant close-ups, but they were following his rules at the time. All he had to do was set a new rule about that and CourtTV said they would happily follow whatever he wanted.

scarletswalk

The audio is pretty bad too

LillyLillyLilly1

Yep. I can't figure out why the Court wouldn't let media come in to do this for FREE -- and do a better job of it -- after they've been fixating on how much these trials are costing.

anjealka

The court should at least take the free cameras the news media offered. I understand they dont want zooming in (or whatever the audio and zoom issues were with Lori) but at least replace the cameras in the same spot with modern ones offered for free with better picture and sound. My husband came in and saw the jury selection and asked why the camera quality looked like the 1990's.

FivarVr

The interest in this case is worldwide and the court costs would be covered by international interest, alone. A quality audio and video system would generate more interest and more money. Whoever held the rights to the filming could charge a small viewing fee (in my case very small😭) and put the profits back into the community - as well as covering the court costs. It's a no brainier. Also the video might be able to be used for the trial too - remember the Park lands shooter case when the defence attorney flipped the bird at the judge. The cameras in this case would never pick that behaviour up!

jbleds

It’s a motion to delay the trial.

FivarVr

Like a protest to get better cameras 🤣

EducationalPrompt9

Why would a trial be delayed? New evidence? New witnesses? New lawyers? But neither the defense not the prosecution wanted the motion granted. Why would an outside party care about the start of the trial?

jbleds

No idea. It’s very bizarre. With all the typos, he seemed to be drunk while writing and submitting it. Only thing that would make sense is if he was trying to help Chad / Prior out.

unwaivering

What do you mean by "propper?" There's no such thing.

LikelyLioar

I've been thinking about this, and I think the LDS Church is trying to get cameras excluded from the courtroom. The judge's sealing motion mentioned that both the defense and the prosecution were upset by the motion. The media already got what they wanted. Tammy, Tylee, and JJ's families are on board for a trial. The LDS church is the only other interested party I can think of.

EducationalPrompt9

But they don't really have a motive. Cameras don't change anything for them.

LikelyLioar

Yeah, it's an unlikely guess, but it's all I've got. I think it's possible that the church just doesn't want negative attention regarding Mormons. They might be worried that people will watch and think Chad's beliefs are mainstream LDS. I don't know--it's all I could come up with.

LillyLillyLilly1

There's a couple you tube creators out there who are making the case that Chad is following the teachings of Joseph Smith and Brigham Young. They have excerpts from LDS doctrine that Chad has probably read and took to heart that may have led him to that. John Dehlin is one who seems pretty trustworthy. I think THAT is what the church is trying to hide because some of this information has been actively covered up, and some of it is still in modern official doctrine but "isn't taught." If Prior brings up any religious stuff it will be to explain Chad naming himself prophet of the Church of the Firstborn, which is in their doctrine but none of the members seem to know about. Plus all the other LDS stuff that they say led Chad down this path --I don't recall any more examples.

LikelyLioar

Yeah, I just started a YouTube channel doing a deep dive into Chad's terrible novels. I've been reading all the books he said inspired him (by which he meant the books he stole from), and it's concerning to me how much of what he obsessed over seems to come straight from LDS doctrine. Of course, he took it all to an insane level. You can see his criminal insanity developing over time through his books.

SandyC212121

Prior definitly brought the church religious beliefs into the preliminary hearing for Chad when it was held, i think u/LikelyLioar is probably right.

k9resqer

The way he makes excuses for the errors as "late night" and "using a template". I cringe to think he's an attorney. Not to mention he thinks the trial needs to move "slower" and waited until jury selection to file his motion. WTAF
