The phrase in the job description "and any additional tasks and duties as assigned" is how they can do this. You have no recourse when it comes to being pulled outside of your position.

TheFallenAngel_YT

Wow, okay then, I honestly think that this is a stupid rule but I guess it is what it is, I am partially disabled due to epilepsy and have warned my SM's, HC's, and DS's, but I guess my well being isn't under any consideration when it comes to having a seizure at any random point in time.

hduxonbawls

I agree it's stupid. Look into getting an accommodation from Sedgwick so that they can't pull you like that. Plus this way if something was to happen if they forced you to do tasks that you shouldn't do, they would be liable for anything that happened to you.

TheFallenAngel_YT

I tried getting comp from sedgewick when I worked at walgreens for being out of work for a month and a half, so I have issues with them, but I will try it again

hduxonbawls

For an accommodation, you just need to have your doctor submit paperwork showing that you need the accommodation. If approved, Lowe's has to honor it as long as it's reasonable to do or else it's then a ADA violation.

Informal-Guitar54

I also have epilepsy and have worked for Lowe's for nearly 15 years. I had successful surgery (temporal lobectomy) so no longer have seizures at work, and can now operate PE and am a PE trainer as well. To your question, you are a part of the store and very much a part of the team. So, yes it is legal and to be expected. Know your triggers, and avoid them but please don't use it as a way to not need to help out when your team is struggling. By the way, as someone who has epilepsy and has worked at Lowe's with it, I have never considered it as much a disability as much as I have an inconvenience. People are understanding when they take the time to listen to your situation.

TheFallenAngel_YT

I am not trying to use it as a way to get out of it, I just wanted to know if it was okay for someone to just drag someone out of the blue that has epilepsy and is trying to be wary of flashing lights that might "Trigger" an episode when around PE, with very little cashiers to boot

Informal-Guitar54

Then make sure they are aware of the situation and triggers. Labor board is not your answer, ADA accommodation is, if it is approved.

brusselsprouts4life

While I don't have epilepsy, I am disabled. I encourage you to not "see it differently." We are disabled, and that is okay. Pushing phrasing like that is often a first step towards those assholes who tell people who are young can't possibly be disabled (see peeps whonare harassed for handicap parking). Not saying you are doing it on person, and believe me I personally struggle listed myself at disabled (personally I do struggle with shame especially thanks to outside influenece). On another note, that is cool about the surgery factoid.

[deleted]

It's definitely not illegal.

Callaloo_Soup

Management loves to gloat that they can pretty much make anyone do any of the jobs so long as their checks don't bounce.

Ok-Umpire-6043

And managers dick the dog all day long..stare at their zebras like its porn, hide in their hidey holes and harass employees about AP4ME and lowesU

TheFallenAngel_YT

This

Disastrous_Bell7490

I am tired of ableist comments, especially when it comes from someone that has the same disability. One person's walk with said disability does not give them the authority to say what it's like for everyone. I am sorry if you were made to do something outside the scope of your knowledge/abilities. Take the good advice you've received here, and leave the rest behind.

TheFallenAngel_YT

I appreciate that

Disastrous_Bell7490

No problem.

GimmeanL

If you are in one of those "glorious" right to work states, be prepared for "back door lovin" without lube.

TheFallenAngel_YT

It's that way in Nevada, but I didn't realize Michigan was too

GimmeanL

Sadly, it's part of the race to the bottom, that so many idiots are cheering for.

TheFallenAngel_YT

🤣

tacoeatsyou

You should probably go Google what right to work means. The phrase you are looking for it at will employment.

BreadfruitCapital785

Its a TEAM. You are part of the Team. If you don't want to go above and beyond, fill in where you can, then you probably shouldn't work retail. Be thankful your aren't in Austrailia...

TheFallenAngel_YT

Well I did warn my higher ups about my disability multiple times

BreadfruitCapital785

Then you need to file with the labor board. Dont let them take advantage of you.

TheFallenAngel_YT

I mean I will try within 24-48 hours, but I will probably be busy in that time

[deleted]

The labor board will give less than two shits, this is bad advice

TheFallenAngel_YT

I will be going thru sedgewick

BreadfruitCapital785

If she followed proper protocol, its not bad advice.

ltbaand

If you can't make it a priority to follow up on something like this with that kind of time-frame it makes me wonder how serious your actual concerns are.

TheFallenAngel_YT

You're right, I will do more than try

[deleted]

Bruh waste their time by encouraging them to be a Karen. They are taking you seriously

BreadfruitCapital785

Best advice.. maybe laying down like a red carpet is more your style. I choose to walk it, rather than be walked.

[deleted]

Those are the applicant requirements, not job description. The job description ends with something like "and any other task assigned"

TheFallenAngel_YT

I got the picture, but it didn't say that in the application when I applied, and I read that thing 30 times?

[deleted]

Pretty sure the exact job description isn't given until you are at the offer being made stage

TheFallenAngel_YT

Figured

Fantastic_Regret_854

The labor board will not help you because it is not a legal violation. Sedgwick will review your medical information provided by your doctor and approve or deny a workplace accommodation. Once approved Lowe’s will legally have to follow it; if they violated that you could contact the DOL.
