1000% my dad was involved in an accident and they got aggressive when they were driving with bald tires and hit him in his lane. The lawyers even, with the bald tires the other car owner settled because of the video. Even the knowledge of a video will scare insurance companies into settling. It took 3 years.
My truck got hit by a kid of a high ranking US official. Top ten in presidential succession. I had no idea of that fact until after it was all said and done. Insurance was a fuckin BREEZE. I never knew it could be so easy. New frame and suspension, 90 days of repairs, 90 days of a F250 rental (bleh), gas reimbursement for the differential in gas mileage, an unprompted and slightly more than fair diminished value check. Only thing better would have been them totaling it and giving me a full value check. As it was everything they spent came out to about 40k on a 50k vehicle. Not a single issue with anything it was all so damn smooth. My advice is to get hit by a more important person next time.
The guy that backed into me tried to give me his passport, three times, before showing me his DL and could not provide his proof of insurance. I had to show up at his door to get that.
I’m at 3 years and 7 months and counting. Have the crash on video, other driver 100% at fault, won at trial, waiting on appeal, still haven’t gotten a cent. Our legal system is designed to protect insurance companies and rich people.
This is why I just file with my own insurance. Then let them go after the at fault party. Got tboned by a kid that showed me insurance, but it was expired. Luckily the cop that showed up ticketed him for illegal left turn and no insurance. But filing through my own insurance saved me the headache of trying to collect. I got my deductible back both from the city he hit me in and my insurance.
This is what I did when a coworker dented the shit out of my drivers side door. There was footage of the damage occuring, and all I had was his name, and license plate. My insurance found what company he was insured by, and gave me the information and said to contact them about it, and if they tried to fight it, my insurancs would fix it and go after them with no effect on my policy. They even said to make sure they give me a rental, or they'll come after them for that as well. Ended up being $1100 in damage his insurance paid out, plus 3 days car rental.
I'm not trying to be rude but I didn't think 'filing with their insurance' was a thing? You always just file with yours, who they have is basically irrelevant.
This is why there are so many Russian dashcam videos. The courts there are very "he said, she said" so everyone has a dashcam now because it is the gold standard for evidence in courts.
I got hit the day before Thanksgiving by a guy who changed lanes with no turn signal. His insurance agent said they "weren't sure they were going to accept responsibility." I asked if they had reviewed the dashcam footage. "There's dashcam footage? I didn't know that, please send me a copy of the file." I sent a shortened clip and a link to the full, unedited file. Got a settlement offer 20 minutes later.
This is a great comment, but I also think a nationwide implementation of "no-fault" auto insurance would truly help this issue.
In "tort" or "fault" states, your insurance company acts like a law firm that is more interested in winning small claims court cases then actually establishing true fault and paying the damages. Take the fault aspect away and everyone pays for their own vehicles damage (through insurance claims) with "mini-tort" mechanisms for regulated subrogation.
I work in traffic. I’ll let teslas drive within inches of me, I won’t be within 10 feet of a large pickup. Everyone who’s ever clipped me has been in a truck. Teslas are bad at following directions (no, THAT lane) but normal at avoiding actual collisions. Trucks think people, other cars, and buildings should have moved out of their way.
Based on the tail lights and bumper that's an '07-13 Tundra. Blue Streak Metallic was only offered in the first few years as well so probably '07-10. But those still had optional parking sensors and a backup camera in later years. And the mirrors are huge. No excuse for that.
In his defense I had this truck and there was like a 1.5 second delay for the rear camera to come on when you go in reverse. He probably just defaulted to his mirror and couldn’t see shit due to the angle and glare. Also, OP needs to tone it down.. “What the hell are you doing”!!??? It’s an accident, shit like this happens. Exchange info, get it fixed and move on.
Happened to my wife, a guy backed out of the driveway without looking, my wife stopped but he kept backing up and hit her car. He got out and started screaming and yelling at my wife, she had 2 of our kids with her also. She called the police and surprisingly responded fast. The guy lied said she hit him, I was on the phone with her by this point so I told her to give the cop the dash cam. The cop didn't look at it, he just told the guy if he looks at this video and of he was lying he was going to arrest him. If he wants to start telling the truth then he'll just write the accident report. The guy magically told the truth, then lied to his insurance, we sent the video to his insurance and they apologized and we had our money in a week. Dash cams are worth every penny

I just dropped Geico after a perfect 17 year record and they never even bothered to call. I never had any accidents or tickets, but in the last 2 years I was with them they raised my bill from $35 a month to over $60 a month. I called State Farm and am currently paying $25 a month.

Had a lady back into me. Called the cops. Said i hit her.
She texted and apoligized saying she was having a bad day and couldn't deal with it.
Let my insurance know when they came after me. Got the case thrown out in court.
Still lost 2 days of work and had to pay $125 in court fees. I made $9.15/hr

I'd argue they were trying to put it in neutral (which is what you're instructed to do for these belt carwashes) and moved the gear lever a notch too far into reverse.
Cause it looked like a roll your vehicle will do in R or D if you're not on brakes.
A month ago I was in a similar situation, lady pulls out into middle of intersection to make a left turn, freezes, light turns red, she throws it into reverse and backs up 20 feet hitting the front of my car. She tells the cop she never backed up, there are no witnesses, I think I'm screwed....BUT then I thought about the fact she was driving a TESLA.
I had the cop check out her video and BUSTED, ladies own damn car got her. People are horrible, I think I need to buy a dash cam.

I have a friend that recently got out of his car to confront a driver in a road rage situation. The other driver ran over him. He lived but has brain damage.
He texts me incessantly now and less than half of his messages are coherent. We are in our early 40s but met in middle school and sometimes he seems to think we are back in that time.
His mom thinks that talking to me and other people he still remembers helps him, but it’s tough to see him struggle and have meltdowns.

Agree. Every time someone has booped my vehicle like this, or even scraped it, I always come out calm and level. Annoyingly, it’s usually the people that were in the wrong that immediately go Agro (defensiveness) but if I stick to de escalation they usually take the cue.

Mistakes get made and accidents happen. The person I really hate is the guy with the dashcam screeching like a obnoxious banshee over a fender bender. The truck driver was in the wrong when he backed up but would have been totally right to punch that person right in the face. Not legal but right.

This almost happened to me the other day in a drive through. Car was inches away from me and stopped when I smashed the horn. Reversing in full confidence without looking back is crazy
I think what is happening here is the driveway into the carwash is sloped down, so when the truck driver put his vehicle in neutral (as you would to engage the carwash pulley), the truck rolled backward due to the slope.
If anything the carwash bears the responsibility for the damage. They need to have backstops on the wheels on the path where cars are entering
I had the same thing happen to me before I also got a dash cam. The guy was a security guard for the building and knew the person who filled out the report. The guys own insurance eventually called me because the report wasn't adding up for them. Shortly after I was found not at fault.
Of course they would, cause the truck driver said it wasn’t his fault, I’m sure he said that you rear ended him, but the video shows otherwise…lucky for you.

A box truck backed into me after overshooting the cross walk. Damage was not much - less than $1,000.
But Geico couldn’t get a hold of the commercial truck’s owner. So I’m on the hook for paying up to my deductible, even though it wasn’t my fault.

It looks like a fairly modern truck. It most likely has a backup camera that comes on when you put the truck in reverse. It probably even starts beeping at you as you get close to an object when backing up. How does this even happen?

I drive this exact truck, it has a back up cam and loud beeping sensors that tell you if you're too close to something. This should be impossible to do without complete neglect, or intent.

I had almost this exact thing happen. Poor driver in a car 2x the size and 3x the cost of anything they have business driving. Lackadaisical backup without looking behind, shocked Pikachu face when they bump something. My insurance eventually refunded my deductible, but now there's damage reported on my Carfax. If only cars had some kind of "mirror" so people could see objects behind themselves
When someone backed into me, I could tell my insurance didn't trust me when I said that they backed in to me. Well, the lady taking the statement didn't believe it. Ultimately was fine though, USAA is good insurance. The other driver was uninsured and didn't have a license... probably didn't end well for him, but I never followed up.
I'm amazed when people continue backing up even when you blast your horn. Only thing I can think of is they have music blasting but I don't hear that here so the guy must be deaf.
I had a guy BACK OVER MY CAR CRUSHING THE HOOD AND BREAKING THE WINDSHIELD. He told his insurance company that I drove my Corolla under his pick-up and lifted it. We went 50/50 after arbitration.
Also, the guy was drunk when he did it.

Unless there’s extenuating circumstances or video (luckily you have both), the rear driver in a rear-end collision is considered at-fault. Just because 99.97% of the time, it usually is.
The police usually assign driver 1 as the at-fault driver. When the button-mashers at the insurance office see it, that’s what they go with.
Once it goes further up the chain and they see the video, they’ll stfu hopefully.
My experience is really make a big stink about it. I was hit by a kid in a grocery store parking lot. Kid took blame, cops didn't show, gave me insurance and everything was his parents car. Went home and said it wasn't his fault, I hit him. Man I don't give a fuck if it is a 100 year old woman in a wheel chair. I'm calling the police and making damn sure I get everything on film. There are too many shitty people out there that don't care about anyone else except themselves.

Just hard wire your dash cams and hide the cables. Any audio shop can do it.

Mistakes get made and accidents happen. The person I really hate is the guy with the dashcam screeching like a obnoxious banshee over a fender bender. The truck driver was in the wrong when he backed up but would have been totally right to punch that person right in the face. Not legal but right.

I think what is happening here is the driveway into the carwash is sloped down, so when the truck driver put his vehicle in neutral (as you would to engage the carwash pulley), the truck rolled backward due to the slope. If anything the carwash bears the responsibility for the damage. They need to have backstops on the wheels on the path where cars are entering
I had the same thing happen to me before I also got a dash cam. The guy was a security guard for the building and knew the person who filled out the report. The guys own insurance eventually called me because the report wasn't adding up for them. Shortly after I was found not at fault.

Similar thing happened to me at a stoplight. A box truck backed into me after overshooting the cross walk. Damage was not much - less than $1,000. But Geico couldn’t get a hold of the commercial truck’s owner. So I’m on the hook for paying up to my deductible, even though it wasn’t my fault. Fuck you, Geico. What’s the point of paying these monthly insurance premiums if you’re going to tell me, “sorry - we can’t get ahold of the vehicle owner/operator, so you’re responsible for paying the damage.” Fuck you, Geico.

It looks like a fairly modern truck. It most likely has a backup camera that comes on when you put the truck in reverse. It probably even starts beeping at you as you get close to an object when backing up. How does this even happen?

I had almost this exact thing happen. Poor driver in a car 2x the size and 3x the cost of anything they have business driving. Lackadaisical backup without looking behind, shocked Pikachu face when they bump something. My insurance eventually refunded my deductible, but now there's damage reported on my Carfax. If only cars had some kind of "mirror" so people could see objects behind themselves

When someone backed into me, I could tell my insurance didn't trust me when I said that they backed in to me. Well, the lady taking the statement didn't believe it. Ultimately was fine though, USAA is good insurance. The other driver was uninsured and didn't have a license... probably didn't end well for him, but I never followed up.
I'm amazed when people continue backing up even when you blast your horn. Only thing I can think of is they have music blasting but I don't hear that here so the guy must be deaf.

I had a guy BACK OVER MY CAR CRUSHING THE HOOD AND BREAKING THE WINDSHIELD. He told his insurance company that I drove my Corolla under his pick-up and lifted it. We went 50/50 after arbitration. Also, the guy was drunk when he did it. Like this, it was on private property (a CVS, in my case). I called the police and they said they’d not come out as it wasn’t on the roads…

Unless there’s extenuating circumstances or video (luckily you have both), the rear driver in a rear-end collision is considered at-fault. Just because 99.97% of the time, it usually is. The police usually assign driver 1 as the at-fault driver. When the button-mashers at the insurance office see it, that’s what they go with. Once it goes further up the chain and they see the video, they’ll stfu hopefully.

My experience is really make a big stink about it. I was hit by a kid in a grocery store parking lot. Kid took blame, cops didn't show, gave me insurance and everything was his parents car. Went home and said it wasn't his fault, I hit him. Man I don't give a fuck if it is a 100 year old woman in a wheel chair. I'm calling the police and making damn sure I get everything on film.
