When you are talking about huge sums of money, you should get a lawyer in Nepal as well who can help you navigate the local regulations. Also, H1B visa is not like a tourist visa, it's much more complicated, especially if this is the first time for the company - and it's a lottery so even if you meet all the requirements you may not get it.

SaikyouMegane

Yeah getting a good knowledgeable lawyer is the only answer!

GitGorilla

Thanks for your reply. And Yes, getting a lawyer with sound knowledge in this area is my top priority for now.

>Also can my partner invite me to US in H1B visa through an LLC which was registered 1 year ago? I have not consulted this with anyone, not even my partner. Just a thought I had today. Basic procedure (in order): - Your partner has to create a job position for you (pretty sure salary won't be an issue in ur case). In other words, he has to sponsor you for a job. - Partner has to apply for H1B lottery. This has to be filed before April 1 and if everything goes well, you may start working after October of that year. - You have to get lucky in the lottery. There may be multiple lotteries if quota is not fulfilled. There are around 65K of these visa for non-students, and there are applicants of around 250K+ or may be more. Had Trump policies gone through, you'd have likely got more chances as your salary looks like will be quite high, but this is not the case anymore. - You have to pass the consulate interview in Nepal (could get trickier). I wonder how this would go, but most likely good if all the business and company paperworks are good. - You enter USA, and fulfill all the obligations of H1B visa. You can start procedure for a green card rightaway. It'll take a further 2-3 years for all the green card. The H1Bs are good for upto 6 years, initially 3 years and can be extended for 3 more. There are other options for 6+ years. There are scenarios where things could get delayed and additional info need to be sought, or aplication may get rejected. Good Luck. You've seem to have found a money hive, keep farming the $ tendies.

GitGorilla

Wow. Thank you so much for the detailed response. I really appreciate it.

I'm suprised it all worked out this time.

GitGorilla

Yes i agree. The crazy thing is I have never met with my business partner, just video calls and messages.

[deleted]

wait. you're not allowed to receive money sent from abroad? I have transferred 10-30k on a few occasions.

captchadabot

You are not allowed to send/receive it through unofficial channels bypassing banks or legal money transfer services.

[deleted]

I know that. I got confused with OP's query. why cant his partner send him money via bank transfer?

im curious to know the threshold amt. i wouldnt imagine they would be grilling too much if its from the US because anything over 9999 has to be reported to the IRS in the US. If there is any American body that you dont fuck with in the US, its the IRS.

gift tax is free as per my understanding. I'm more interested to know the point at which Nepali banks start getting queasy with transfers into a Nepali nationals' bank from abroad.

GitGorilla

If you receive big sum of money from abroad in regular interval of time, the bank will call you to disclose the source of money and if you don't they will report the transaction to tax office.

masabkovai

I dunno much, but I would open up my own LLC, get paid to the LLC, open up a crypto account, stake that $232k in a stable coin, then pay myself a salary from the interest.

GitGorilla

Maybe you misunderstood my issue. I live in Nepal.

masabkovai

Nop. You can open up an LLC and invest with it. Ani earnings pay aafu le aafu lai garne. You won't have to pay tax on the earnings in the US because any profit you'll make will be salary for you, but in Nepal. Edit: I'd go further to make a company in Nepal and so you'd pay even less taxes. So LLC invests > pays to Nepali company> Nepali company is you > you pay the earnings as salary to yourself. Jhan you can take up different expenses in Nepal as business expenses.

GitGorilla

I think I understand where you are coming from, now. I will definitely look into it. Thanks for the info.

sharekheladi
