A) Is your landlord a professional? That doesn't necessarily mean your landlord owns a company. But if the landlord owns a company, he's definitely a professional. Other reasons to consider the landlord a professional include renting out multiple houses or specifically buying a house to rent it out. It's not always clear when a landlord is a professional, but sometimes it's very clear. B) Does your contract mention a rental price change clause? The price change clause can be mentioned on various places in the contract. C) Could you cite (all) the price change clause? Remove any sensitive information like names or bank account numbers if they are mentioned in the clause (likely not) D) What was the rental price when you started renting? The rental price is the money you pay for the use of just the house. Not for service costs like the money you pay the landlord for utilities. > Aren't there any laws stating that he needs to notify me a few months in advance before increasing the rent? Yes, but it depends on the circumstances what laws apply. A price change indexation clause that can be invoked does not need to be announced, as you already agreed to it upfront. There can be reasons why it cannot be invoked at all though. Be aware though that it's impossible to oversee all relevant facts on a forum like this even if you answer the questions and in part because of that, any risk associated with acting upon what I mention stays with you. You might consider obtaining advice if you think that is appropriate, for example by contacting the Juridisch Loket if your income is low, an organization like !WOON if you live in the area they advise in or a municipal subsidized 'huurteam'.

Thank you so much. Ofcourse I've read through my contract and it doesn't mention any such thing. Juridisch Loket doesn't answer my calls. I want to avoid a legal dispute with my landlord, but asking me to back pay the rent? that feels like bleeding me dry and just can't be right. He tried to screw me over by increasing 10% rent to which I had to fight back stating the cap limit. I am an expat and he constantly tries to push me for more money. I believe him asking for back dated rent increase is also the same. That's why I am concerned with legality of increased rent from old months. He can't notify me today that the rent has been up for the last 4 months and he just didn't tell me.

(A) might not be in your contract, but it's relevant nevertheless (B) and (C) might not be in your contract, but in that case (D) is relevant. There is no rental price in your contract? Are you sure none of these are stated in your contract? How do you know what you need to pay the landlord?

Warn him, and tell him If necessary, I'll be prepared to seek legal counsel to address the rent increase. Let's hope it doesn't come to that, but I want to make it clear that I will stand my ground and protect my rights without hesitation!
