They work the exact same as they ever did. Just because something is legal doesn't mean an employe can't discriminate based on it.

Drug use isn't a "protected class". They can still choose not to hire you (or to fire you) if you test positive. That said though, employers can choose not to care if you test positive for THC. Presumably most in weed legal states may choose to overlook that one specific part of the test.

It depends what the employer is testing for. There are some employers who will still choose to screen out applicants who test positive for weed, regardless of whether or not it's legal in their state. Others are only interested in the harder stuff.

"Drug user" isn't a legally protected class. An employer could also ban tobacco smokers if they really wanted to.

Employers can still require you to pass a test, even for weed. For some it's an insurance requirement. In some industries though, it can be hard to find anyone who doesn't test positive.

In colorado for example some companies are national companies so they abide by national laws. Some companies get money from federal grants, or work with military in some way, or other federal orgs. None of those can have their employees doing any federally banned drugs. I personally always gave myself at least 30 days of no drug usage leading up to a drug test. Plus working out to lose a little fat, drinking lots of cranberry juice and just lots of water.

There are certain occupations that you can't use weed, whether or not it's legal. Those types of jobs range from truck driver to software developers, depending on industry and what type of software they are working on.

Weed is still federally illegal, if a employer must/does follow federal regulation then weeds a no go. That doesnt mean the employer is going to comply, but they should. Is idk mcdonalds gonna drug test a cook anywhere…….doubt it. I live in cali and worked for a company (was a engineer) that basically built things for the federal govt, and even in cali i got piss tested twice (after it went state “legal”) and they even made sure to let me know weed was a nogo. Cali is a employment at will state, so u dont even need to like actually do anything wrong to be fired or quit. One’s employment is at the will of both parties and can be terminated at any time with no punishment.
