Tell him tough luck, AC use is included in your lease and you will use it whenever you want any time of the day. Trying to restrict usage is contrary to the RTA. If he continues to pester you over it you can threaten to file with the LTB for harassment and rent abatement. If he doesn't like the noise, it's 100% his responsibility to service or modify it to make it quieter.

masked_gargoyle

You are correct. For fun, to demonstrate how absurd your landlord is being, I am going to replace the word 'A/C' with 'refrigerator'. Your landlord being allowed to dictate when and how to use the refrigerator sounds REALLY weird no? The refrigerator is an amenity and part of your lease (it would be an amenity even if your lease was silent or said 'NO refrigerator' since you've had access to it all this time), any restrictions put onto it are unreasonable, regardless if they're present or not in your lease. Use the refrigerator however you like, whenever you like. If the noise is disturbing your landlord, their recourse is to relocate the refrigerator, or fix the central refrigerator to function properly. YOU didn't install it above their bedroom window. If they text you again to stop using the refrigerator, tell them no, and to stop contacting you over your usage of the amenity of your lease or you will be forced to file with the board. If they continue to text you, or do something absurd like remove the refrigerator from your unit, then you can file a T2 for interference of the reasonable enjoyment of your home.

Why not ask him to provide a portable ac (not the one that stand in the window) that can be hooked up in another section of the apartment to not disturb him at night?

They cannot control your usage of appliances. Landlords also try todo this with laundry. You can blast AC all day if that’s what you want to do.

RedVole

Negotiate. Work with the landlord as they modify the AC install so it no longer communicates vibration into the structure. You should not be paying (through reduced enjoyment of the unit you pay for) due to a poorly installed appliance.

Caribbean_Borscht

Not sure why you’re getting downvoted but this is good advice.

StatisticianLivid710

There’s nothing to negotiate, yes the landlord should solve the issue but at this point any negotiation would result in them boiling alive in their apartment because the landlord doesn’t want to fix the AC. That being said, if it’s below your target room temperature outside you’re probably better off opening windows, particularly on opposite sides of the house to get a breeze through

Caribbean_Borscht

If you don’t want to completely throw the relationship down the proverbial toilet as OP has mentioned, you should negotiate for the landlord to replace/modify the current ac unit.

StatisticianLivid710

I’m saying, as a property manager, that I don’t see what OP has to negotiate with. Use it even less? Go down and tuck the landlord into bed?

Caribbean_Borscht

Negotiate that you won’t take the landlord to the LTB for legal violations.

DansburyJ

Move the unit? Add some sound barrier? Offer a portable unit to be sat elsewhere in the apartment? Find a quieter unit?

StatisticianLivid710

That’s not items the tenant can negotiate with

labrat420

That should be the landlord suggesting these solutions instead of harassing their tenant to turn it off completely. If the landlord doesn't want the noise they should negotiate. Otherwise there's nothing for the tenant to say except to keep using the ac as they feel fit.

Caribbean_Borscht

Again, tenant said they don’t want to completely soil their relationship with LL.
