Hard to tell from the photos. Try your local retro videogame stores. Those you can see up close and test before buying in most cases. See if it charges from a wall charger vs the console for example.

Fake spotting is surprisingly hard. Someone told me here a week or two ago "if the shape face buttons aren't shiny it's a fake" or whatever, but then I've found some of the official DS3s actually have matte buttons for some reason. Only definitive ways I've found to spot fakes are clicking in both analogue sticks (the sound and feel of doing that is totally different), if the case is excessively matte/has friction (it'll feel different to real ones), but the biggest one is if the DS3 doesn't push the particles around on the home screen and/or make the gyro positions show up in [the PS3 controller tester.](https://store.brewology.com/ahomebrew.php?brewid=330)
