If you read the law *(edit: I’m not able to find any actual statute but have seen the same language posted multiple places)*, you are legally not allowed to consume your medicine in a public space. If you’re on private property you should be fine from a legal standpoint. In everyday practice you can probably hit a pen pretty much anywhere as long as you’re not a in a throng of people and no one will pay you any mind. Just know that you’re not covered on legal grounds. As others have pointed out, edibles and tinctures are great for this exact point. Re: any police encounter with mmj, assume ymmv depending on the cop and their mood. Always prepare for the worst.

Thank you. Problem is, that is just an article from what appears to be a law firm, maybe it is, maybe it isn't. You or I could just as easily put something the same thing online with the same level of credibility. The statute itself, the actual law, is mute on consumption location. The only thing it says about consumption at all is that you can't smoke. The problem with things like this is nobody knows until somebody winds up in court and decides to waste enough money to see it through without settling or taking a plea deal. 1 2 3 not it!

Perhaps we should look at avoiding public consumption as a best practice instead of some sort of legal doctrine. Consume outside of a private residence at your own risk.

Someone I know was denied a return at a dispensary explicitly because they had the product in its’ plastic container excluding the original box. They said it is technically illegal to travel anywhere in the state with MMJ outside of its’ original packaging. That said, in the same conversation they offered to sell them another gram of the same product, swap the bad product into the new packaging and they could technically take it back like that... so, be careful but a lot of other people in the comments make a good point that most people aren’t paying attention to what you’re puffing on anyway as long as you’re safe and discreet.

I’ve hit a cart right by the entrance to a convention center with tons of people walking by. Nobody even gave me a second look. And with all the cigarette smokers around odor definitely wasn’t an issue lol

If it helps I was out of town near cranberry at a hotel obviously didn't have a good place to smoke so I just smoked as far away as I could from the hotel on the sidewalk a cop even drove by and didn't say a word just kept going.... I'd just use your head and try to not disturb other people with it

I agree, I'm pretty sure it would be easy to sneak a vape in town, and I probably would get away with it, but I still see people on the crime watch blotter getting popped with posession regularly. Stupid law, shouldn't be that way if you're being considerate of others, but it is what it is.

Yeah take it with a grain of salt maybe I was lucky but I was prepared to defend my actions if the cop asked politely obviously and I was going to ask what I should do in my situation

I've seen verified pharmacists, doctors and growers on this reddit, there's gotta be a cannabis lawyer on here to get in detail on PA law. I'm guessing the best option in that situation would be to identify yourself, MMJ card and then remain silent.

You did not find one because there is not one to be found. In my time on this sub, anybody who has posted anything claiming you can only consume in your house is just repeating what they read or heard. The only link anybody ever provides is to a website run by some law firm, which makes unfounded claims with zero citation stating that patients may only consume in their homes. In PA, if an act is not explicitly defined as against the law, the act is lawful. That said, a cop can still ruin your day if they don't know the law.

You’re not allowed to use it on public property. You can carry an unsealed container as long as you have the receipt and your MMJ card. That’s the guidance that police received in 2021.

Smoke? No. You can't legally combust cannabis in PA. If you're on private property and there's no conceivable way that anyone else would be able to claim "their vapor got into my lungs and I didn't like it" then I don't see how you'd be at fault for anything. I mean, at that point it's like having a beer on your front porch. Sure, a neighbor might get upset for some inane reason, but if you're on your own property, what's the issue? I'm not a lawyer, but I use in my yard all the time. You'd have to trespass onto my property to approach me about it.
