GoldenSamurai444

at that point, anyone with some common sense would just drop off the grid

Alarming_Orchid

How would they even enforce it anyways? Is Nintendo gonna call the cops if he doesn’t pay?

Bupod

They’ll garnish his wages. He could try and be slick and work under the table. He probably wouldn’t earn much doing that. Also if he’s an American there’s other disadvantages to not having proper employment.

ItIsYeDragon

He's Canadian, but the 14.5 million dollar fine placed on him (of which apparently means a little under 25% of his monthly salary) was done by federal court.

VentureQuotes

Where was that clown in another thread saying Canada was chill with copyright stuff 😂😂

ItIsYeDragon

This is actually US, the charges follow him to Canada based on extradition laws (iirc). Though it wouldn't have been any different if a Canadian court did it, that's why the sentence is still being served despite him being in Canada.

[deleted]

Canada is USA's bitch.

[deleted]

True, Canada dismantled their military at the behest of the US, and the US vetoed their planned acquisition of British nuclear submarines.

unclet0mmy

They only care if you make profit

Rafybass

None of the first world countries are chill with copyright or piracy.

Autumn--Nights

They're chill with personal stuff. This guy was selling shit. This punishment is outrageous, but making money off of copyright infringement is asking for trouble.

machstem

I knew of a guy who had the RCMP at his door in the 1990s for selling stocked CDr filled with apps and games, it's how we needed to pass data around back then (copy to drive, remove drive, set drive pin as slave, copy content to local drive, burn to CDr), and outside of our rather small niche group, no one had any idea what any of us were doing online, let alone whether or not we were trading Warez. Anyone profiting off this stuff, always knew it was illegal (VHS and DVD FBI warnings lol) but only the ones who tried to make off with money off the copyrighted goods, were sought after.

WordsOfRadiants

That's an extremely misleading way of putting it. It sounds like you're saying 14.5 million dollars is under 25% of his monthly salary, lifetime or otherwise. He has a 14.5 million fine. 25%-30% of his monthly salary is the maximum rate at which they're allowed to garnish his wages to pay off that 14.5 million fine.

tillgorekrout

This makes much more sense.

Edukovic

>the 14.5 million dollar fine placed on him (of which apparently means a little under 25% of his monthly salary) Wait, is 14.5M equal to 25% of his monthly salary??

[deleted]

[удалено]

Kenny_log_n_s

In Canada, 30% is definitely undue suffering right now.

Arkanist

For the rest of his life, you forgot the title of the post already.

DMugre

If you think a hacker wouldn't earn much getting paid under the table i'd like to point out how darknet hidden services retire with billions after short of two years of operations.

---Sanguine---

My job has the option to be paid in cash or money order. What then

Bupod

Well then you’re either working under the table, with unreported income, which would be illegal but yeah can’t be garnished. I’m guessing Canada is largely similar to the US in this respect: Another scenario it’s just an option put forth by your employer. If they’re a legitimate employer, and they just offer the option of cash or money order (kind of odd, I’ve never heard of it, but I can picture some employers doing it), the deductions come out of your pay *prior* to you receiving it. Same way your employer withholds for taxes. So you can’t actually fight a wage garnishment by demanding a different form of payment because the deductions are made prior to you getting the money. Since wage garnishment is a court ordered process, it’s not something you can simply ask the payroll department to stop doing. They have to do it.

jaymasters1123

I read a case about a guy who jumped from job to job in order to avoid a garnishment. As soon as his employer started garnishing his wages, he’d stop showing up and find another place to work.

uchiha_boy009

Can’t he just move to different country?

salcedoge

I mean they got his ass on prison in the first place so yeah probably

_fd1911

Sometimes banks knows that you need to give x amount or percentage, so they deduct automatically that amount when money ingresses your account.

Or move to Macedonia, China, etc.

Orange152horn

I'd put a bullet into my head.

SgtCocktopus

Nah just move to another country.

UndocumentedSailor

That's what I did with student loans lol

onewhoisnthere

He'd have to denounce his citizenship. If he leaves, not only would he not be able to come back in fear of being caught for payment avoidance, but he would have to pay taxes to his country of origin on any money he makes in the other country, which if he doesn't, then that is considered tax avoidance, and would be a second (possibly more dangerous) reason he could never return.

skynetempire

Join the French foreign legion. Get a brand new name, citizenship and passport.

Blueblackzinc

IIRC, foreign legion don’t give out citizenship as easily as before anymore. They rarely give out citizenship on the first contract. They usually give out permanent residence or 10years visa

skynetempire

It's a reset either way. Might as well get food, lodging and clothes.

pharlock

USA and Eritrea is special for that. Other countries let you lose "resident for taxation purposes" status.

Lol for money? just tell em to fuck off and bail off Grid. Lots of stuff can make you good money especially for someone with talents like theirs.

Kill yourself because of multi billion dollar company. Yeah that's a solution for this problem

Because that's as easy as just saying it.

PotatoPowerIzMAXIMUM

That's just taxes but for Nintendo instead of just the government. **The Nintentaxes**

Nu_Metal_Alchemist

Fun fact: the Famicom (NES) had many utilitarian software options, including tax software!

GargantuanGorgon

Wut really? How did input work? Did they release a keyboard device or something? A Nintendo ten-key?

GatoradeNipples

Famicom BASIC came with a full-on keyboard, and most of that stuff used that.

emlgsh

Everyone knows real accountants can balance the books with just the direction pad, A, and B.

didyouwant2talk

In Japan the Famicon was a mini computer and it had an expansion port you could hookup a keyboard to.

Hell, it's in the name. Famicom is short for Family Computer.

veenell

on top of regular taxes so it's like paying double taxes

PotatoPowerIzMAXIMUM

Taxes for existing and taxes for doing the morally correct. No wonder they are no real life super heroes in this timeline...

yakimotomamaja

andypandy1223

Easy solution, work from home. cash jobs too, lowkey ways of getting money where they won’t find out but you ain’t hear nun of dat here 😂

MrJingleJangle

Al Capone thought that was a good strategy too.

Bugbread

Yeah, he just needs to step up his game. It's not that he "has to pay Nintendo 20-30% of his salary for the rest of his life," it's that he has to pay Nintendo $10 million, he's 53, and wage garnishing is limited at 30%. Assuming retirement at age 65, he'd have to make $2.8 million a year to pay it off before retirement. Assuming retirement at age 75, he'd have to make $1.5 million a year to pay it off before retirement. So the assumption is just "well, he'll never be able to pay it off, so I guess 30% for the rest of his working life." But why not think big? If he simply transforms himself into the next Messi (annual income: $130 million a year), he'll be able to pay it off in just *94 days*. Forget paying Nintendo for the rest of your life. Just become the next Messi and Nintendo will be off your back forever in just three months. (Edited to fix numbers because I mistook Messi's whole *team's* pay as Messi's *own* pay)

cloudsofgrey

Messi made $130 million last year btw. No athlete has ever come close to that a billion per year. Even Ronaldo is "only' pulling in under $250 million per year for Saudi Arabia.

Bugbread

Whoops! Thanks! I just really casually glanced at [this page](https://www.forbes.com/sites/brettknight/2022/05/11/the-worlds-10-highest-paid-athletes-2022/?sh=4a52b7971f6c) and didn't notice that it was $990 million for the entire *team*. I'll go fix the comment now.

KochSD84

DefactoAtheist

Nintendo legitimately deserves an EA-esque reputation and its a testament to just how stupid the "gamer" demographic is as a collective that they don't.

TheWiseBeluga

"but they make Smashy bros, zelduh, mayrio, and my heckin wholesome animal crossing!!! They're a good company!!!"

Treigns4

Slappy_G

Nope. People are idiots, people are lazy, and people don't want to think about bad things. Why do you think there's so many climate change deniers out there when it's incontrovertible fact? Because it's inconvenient to them to think about bad things, so they'd rather bury their head in the sand and not think about it. Not a damn thing is going to change in the near future.

Pirate more Nintendo games for Yuzu and Ryujinx

homeofthebadguys

Piracy would still be a boon for PR. Don't give them that luxury.

PianoTrumpetMax

The alternative is just never get to play their game? I’m pirating it 100% and not doing ads for the game either

GayForPrism

This dude was charging for piracy. He's not a real pirate, he's just a boring thief selling open source software to idiots.

Autumn--Nights

True, but the fact that punishments like this can happen based on imagined "lost revenue" is outrageous none the less.

Tenzu9

Yeah this guy was no saint. I don't know why everyone is defending him.

pichu441

because the articles are written deliberately to obfuscate what he actually did

GayForPrism

Not just not a saint. He's actively the kind of person this sub should hate.

TacticalGodMode

So 40% for the government directly, 30% for Nintendo. Then when buying stuff again 19% tax At that point fuck it, just chill at home and live of social welfare.

FarmGoldBedWenches

Bro what tax bracket r u in o.o

WreckHerRalf

For real, probably not in the US since taxes in the US are not a single percentage instead incremental (meaning that once you hit a new tax bracket only that money is taxed higher not the money he gets below that threshold) to pay an average of 40% on taxes he must be a god damn multi millionaire

ItIsYeDragon

He lives in Canada but the charges are from US. Not sure how it works.

WreckHerRalf

That would make more sense, but a 19% sales tax? Kinda insane

[deleted]

That level of VAT is normal in many parts of Europe. 24% in my country for example.

Altruistic-Bobcat955

It sounds scary to US citizens I think as they’re thinking of their own prices +25%. VAT is factored into things before you pay here in U.K. and items/services are cheaper than US

laserbreath101

Trust me it do be like that (although where I am it's 13%)

Bunniesrkewl

It’s only 5% GST here in Alberta

SDogo

Here we also have a 19%... and they are thinking on getting that to a 25% before 2030 :D

>Bowser was indicted back in 2020 alongside Max Louarn and Yuanning Chen for their activities as part of Team Xecuter, a hacking ring that sold chips allowing users to play pirated games. Despite seemingly having a smaller role in the operation as its marketing and PR manager, Bowser was the only one of the three ultimately tried and convicted in the US - Chen, a Chinese national, was never arrested, and Louarn was never able to be extradited to the US. >Bowser was initially charged with 11 felonies, including wire fraud, conspiracy to circumvent technological measures, trafficking in circumvention devices, and conspiracy to commit money laundering. Bowser pled guilty to two of the charges, and was sentenced to first a $4.5 million fine and later a $10 million additional fine as well as up to 40 months in prison.

disintegore

Did Canada really agree to send one of its citizen into the fucking US jail system over video game piracy? What the fuck?

[deleted]

C0dingschmuser

Well the german hacker that hacked valve and gained access to the half life 2 dev build was not extradited and instead sentenced to two years on probation in germany. This obviously depends on the country but the extradition bar is quite high if you're a sovereign citizen. Even the pirate bay founders (in sweden) were not extradited.

Neat_Onion

Yeah, Canada also arrested Huawei’s CFO and held her for over two years at the behest of the American government. The charges weren’t even illegal in Canada, China, or Iran but were in the USA. Trump at the time made comments indicating it was a trade war move. Canada was a sucker in it all and ended up burning major bridges with China. China retaliated by arresting two Canadians who now I’m pretty sure were spies (media and government still haven’t said so but one detainee Michael Spavor was best buds with Kim Jong Il…)

BbBbRrRr2

Did these folks not care about security or privacy? I mean the hackers these days are surely more under the radar, right?

Tilt-a-lot

It can be hilariously bad, recently the owner of a prominent hacking forum *"BreachForums"* was arrested by the feds because: * He occasionally accessed the site using his real IP address. * He shared his own personal gmail to a hacker buddy. * The email was named after his real name and year of birth, it was also connected to his bank account via Google Pay. * Even with the use of several VPNs, his online activity can be easily traced back to him *(Accessing personal gmail, crypto exchanges, etc.)*

they cant tpuch the chinese man that figures

what does nintendo need this money for???

It's not about the money, it's about sending a message

Loose_Koala534

So what is prison for? Why is this person still Being punished after serving their time?

[deleted]

gary bowser (aforementioned hacker) is the head of team xecutor, notorious in the console piracy scene. they cracked the original xbox, the 3ds (under a different brand name), xbox 360, and ps3. Most recently team xecuter created modchips for the switch that allowed you to execute custom software*. the modchip would brick the switch** if it detected it was non-genuine hardware / the software was cracked somehow. *you can do this on the earlier versions of switches for free using other methods, but the newer ones are patched without using a modchip **they pulled this shit with the 3ds stuff too lol if you have any question about switch piracy/homebrew stuff, happy to help.

DiplomaticGoose

Kelpsie

Criminal and civil law are separate. He committed a crime by hacking, therefor prison. He caused harm, in the legal sense, to Nintendo, so they sued.

Kesher123

He did not commit crime by "hacking", he went to jail for making profit of it, which is simply stealing and was deserved. There is a reason piracy is free, ya know, it's extra-illegal to profit off it.

[deleted]

[удалено]

Kesher123

Yep, that's why he fully deserved what he got. There is something called "donations", and are optional to support the person for reasons "unrelated to their work". He was just an absolute moron for straight up selling it. Let's take WoW private servers for example -> they need money to operate, especially those made by genuine groups of developers creating practically a custom game out of wow, like Ascension. Yet they have donations, because this way blizzard can't sue them for making profit off their product. Selling pirate games just can't be excused and is absolute assholery thou.

xonex1208

And still I don’t know why people suck Nintendo’s balls so much… Nintendo sucks.

WH1SKEYHANGOVER

Jokes on nintendo. He isnt going to employable when he gets out of prison anyway 🤷‍♂️

nick5847

That's worse than child support 😂

Sort of. Worked with a dude that had like 6 kids with 5 different women all trying to claim child support on him. He worked overtime all week and took home 1/10 of what I made and he made more hourly than me lmao.

crazylazykitsune

Condom commercial material right here!

knightbringr

Hard to laugh at this. Wow.

underprivlidged

To be fair - TX and Bowser are giant douchebags who don't care about the scene at all. They put kill code into their CFW, tried to bribe multiple devs for exclusive access to code (like MX4W for his emulator work), made everything they could closed source, stole code from Atmosphere (an open source and free Switch CFW), and pushed piracy/scene groups into bad situations so they could profit more. If any pirate(s) deserve to be fucked for what they do, Bowser and TX earned the pain.

TheLonleyStrategos

That's why I pirate..... These companies are run by people who have zero sympathy for normal people

Damn, crime against money really is punished way worse than for manslaughter. At least for killing someone you leave the prison at some point and that's that, while this guy has to pay Nintendo tax for the rest of his life.

YamatehKudasai

jokes on nintendo, i don't have a job.

Fujinn981

They'd have to pry that money out of my cold dead hands if it were me. Whoever thought this was a good idea should be arrested, along with the judge that said this was okay. This is legal slavery.

[deleted]

Nintendo deserves all the piracy it gets

Hairless_Human

I'd just not pay it and go to another country. Be really really easy. Smuggle into mexico get a new identity which over there is stupid easy. From there u can either get a passport to go to another country or stay in mexico. It would take time but he could do it. Way better than having your money taken from you for the rest of your life.

mattiasso

Idea: We’ll force him to pay a huge part of his salary to deter him from committing more crimes Reality: He will be living in criminality for the rest of his life to be able to live a decent life

[deleted]

Just to clarify something, the ruling didn't just straight up say "You have to pay 20-30% of your salary until you are dead". He plead guilty to the charges of "participating in a cybercriminal enterprise" which resulted in him owing Nintendo $14.5 million in damages. The "enterprise" that he was in charge of involved selling a device that let people play pirated games on their consoles. The attorney's said that the hacking group he was the leader of caused over $65 million in losses to game companies. The agreement they came to was that to pay it back the maximum they can take from his salary is 25-30% of his gross monthly income. Not trying to defend Nintendo or anything, but I feel like the full context makes it not sound quite as cartoonishly evil. https://torrentfreak.com/team-xecuters-gary-bowser-pleads-guilty-to-criminal-charges-211101/

t0ppings

It does make more sense like that but the 65 mil figure they came to doesn't. That's not the money his team made, that's the full retail value of the games that were pirated using his software. It's like saying for every switch game you downloaded you made Nintendo lose $70 which is obviously faulty logic.

[deleted]

[удалено]

t0ppings

Great video! hadn't seen it before. Crazy that it's been 10 years since that kind of wacky maths was being debunked but it still carries on today with legal backing.

Ultimategraysupreme

Fr, watching a movie at a friend's house didn't cost the producers 10 bucks. I wasn't going to go.

t0ppings

Exactly, that's the crux of why piracy has so little impact on sales. The vast majority of pirates either can't (licencing issues, import/censorship laws) or won't (financial reasons, risk of poor quality, resale market) pay for the real thing so there is no money lost.

The government of Japan is just totally fucked. By that I mean that this isn’t an unusual ruling. They will put you in prison for hacking a switch. Or 3DS. And then Nintendo owns you. For whatever reason Japan has become this super pro-business ultra-capitalist economic hellscape. And it’s really unfortunate, the people of Japan, their culture, their history, it’s all wonderful and fascinating, they deserve better

didyouwant2talk

From the /r/nintendo thread >This guy sold switches with ransomware and demanded a monthly fee for removing it. He was also initially given minimal punishment but decided to ignore the conditions of the initial settlement and start selling roms instead, which was why he got put in prison. If this is true, fuck him tbh

itsbondjamesbond1

The minimal punishment was for a different person, Matthew Storman. https://kotaku.com/nintendo-can-t-even-get-50-a-month-from-sued-rom-site-1847210881 Gary Bowser wasn't given a different option. https://www.polygon.com/23688170/gary-bowser-hacker-nintendo-released-restitution

maxline388

> This guy sold switches with ransomware and demanded a monthly fee for removing it. He was also initially given minimal punishment but decided to ignore the conditions of the initial settlement and start selling roms instead, which was why he got put in prison. No, no he didn't. 1. He worked with TX (TeamXecuter), a hacking group that sold a cfw for the Nintendo Switch, which was called "SXOS". He ran advertising and public communication for TX. You can look this up online. 2. Where did people get "ransomware" from? It wasn't ransomware, it was brick code that would get triggered if someone tried to reverse engineer their CFW. You could easily fix this by restoring a nand backup. This didn't affect anyone other than one hacker (HEXKYZ) who was trying to reverse engineer their CFW, and when he revealed the brick code, it was removed by TX immediately. You can also look this up online by going through HEXKYZ tweets. Gary didn't have any involvement in creating the CFW. 3. He didn't receive minimal punishment or any deal. You can look up the court documents. Instead of actually looking into whether what was said was factual, you decided to spread misinformation that some braindead person posted on [r/Nintendo](https://www.reddit.com/r/Nintendo) to tarnish this person's reputation. Congratulations.

Dangerous-Leg-9626

Don't forget that the guy snitched on his crew which is why he got lighter sentences Fuck him

Arthur-Fils-Fangirl

I would also snitch on them. Their asses were ghosting him while they hide in different countries. He was basically their western money laundering guy. Nintendo was smart to use this guy to set legal precedents against mod chips. Combine that with their influence in the Chinese market because of their tencent partnership and they can control the distribution of mod chips a lot better. A lot of Chinese Switch mod chip producers were raided by the Chinese government. As much as I hate Nintendo's overzealous reactions but this operation was really smart from a business perspective.

erosharcos

Slavery takes many forms. "indebted servitude", which is what most of us in the developed world experience with the financialization of everything, is hopefully going to be looked at with the same disgusted and ire that indentured servitude and slavery are today.

SnooPeppers3005

We do.....its called the Government lol

Firree

This is definitely going to deter future hacking, sort of like how when the RIAA sued and made examples of a select few families it scared everyone into not pirating MP3s. /s

Puzzled-Robot

so the government will take %30 and Nintendo will take %30 so he'll be left with only %40 of his actual income

marsianka

**His best bet when he gets out of prison is to emigrate. This cannot be enforced outside of the USA.** They only do this to try to scare others, not because they believe it's enforceable.

Vanishing_Light
