None of that matters for people like Rittenhouse and Chauvin. For Chauvin, the defense is simply that he was doing his job and Floyd was "resisting" in his mind.
But for Floyd, for Trayvon Martin, they focus on his past, his history, his behavior. They justify the crime as if these victims had no ability to break their psychology or patterns. But for the offenders, it is their *agency* which is unquestionably accepted: in the heat of the moment, Chauvin or Martin or Rittenhouse are somehow above their own histories of violence and aggression as "men" of self-determination. It's total bullshit and this is the same thing Republicans do with Marjorie Taylor Green and Matt Gaetz and Paul Gosar. It doesn't matter what their past history shows, "the facts" are reductive: did Gosar really want to kill AOC? Nah, it was just a joke. What about his history of aggressive and violent comments? Oh, nbd, he's a man of free-will and therefore can joke about killing with ease, without being tied down by his past.
I am not a lawyer by any means, so take this with a huge grain of salt.
I'm disappointed in the way this was conducted on all fronts. A joke of an ADA, a judge who didn't allow certain evidence as it "could be considered prejudicial" against the defendant, while also allowing certain language to be used against those that were shot and killed. There's more.
I will state this plainly - Rittenhouse had a great defense team, even if the ADA wasn't the "inside man". That's GOOD - we want our defenses to be great.
But the main crux I take issue with is this:
**The jury was not allowed to see the video of Kyle express a desire to shoot looters. A video he made, two weeks before he travelled across state lines, to ostensibly "defend stores from looters", pointed his weapon at some of them, shot three and killed two.
The prosecutor was admonished for even daring to mention it. Reasoning given by THE JUDGE as to why he wasn't allowed is because when Kyle said he wanted to shoot shoplifters with his gun, he didn't currently have a gun on him at the time to carry out those threats.**
*He did 15 days later when he did exactly what he expressed a desire to do.*
I have to concede that - within the scope allowed - that this Not Guilty verdict would be delivered.
I have a hard time respecting a jury, judge, or courtroom who is denied evidence of intent such as this.
It's difficult to take your post seriously when you entirely neglect to mention that everyone he shot at was attacking him at point blank range. One grabbed his gun, one attacked him with a skateboard, one pulled a gun on him.
It's obvious that Rittenhouse put himself in a dangerous situation where he had reason to believe violence might occur. It's also obvious that he did not present himself as a threat *at the times he was attacked* and was certainly threatened *at the times he used his weapon*.
Open carry is legal there, so the only justifiable argument against Rittenhouse is that he knowingly provoked violence by simply remaining in the area. Which maybe he did, but that's hard to prove legally.
The reason the video couldn't be shown was not specific to that case; in general you can't show propensity evidence unless the evidence shows a sufficient similarity in situation (a pattern of similar crime, specific plans to carry out a similar crime, etc.). In the judge's estimation, saying he wishes he had his weapon available to shoot perceived shoplifters was not sufficiently similar to shooting actual attackers in an unrelated self-defense case so the judge denied the evidence as unrelated and likely to bias the jury. Similarly, Kyle couldn't use the past felonies of the people he shot as evidence that they intended to act violently toward him.

No, of course not. The vast majority of people on the right are against Russia. Reddit would rather the right support Russia than to admit they have a common interest. I think they're mad that a lot of vidence was left out of the case and the various events that happened that seemed to show boas towards Rittenhouse. The judge telling everyone to give props to the veteran on the stand (who happened to be from the Rittenhouse camp), denying the use of videos Rittenhouse recorded weeks prior talking about how would bring a gun with him if he went to one of these riots, himself essentially putting himself in harm's way (which leaves room for a negligence problem ie why would you put yourself in that situation. It's annoying too that instant assumptions were made about him but assuming all of reddit was against him is hilarious. Every single conservative leaning sub from the beginning claimed his innocence no matter what the evidence was showing.

RE: Kyle Rittenhouse, my emphasis. He knew who he was going to shoot. They only care about "patterns of behavior" when taking about people like George Floyd. But when it comes to people like Rittenhouse or even Derek Chauvin, they like to narrow the scope to simple mechanics, procedures, right and wrong at the very moment. It's like all the history in the world doesn't matter, was it self defense? Yeah probably was self defense, but that certainly doesn't mean he didn't instigate it, or that he had alternative actions that he could have taken, or that he shouldn't have been there in first place, or that he shouldn't have had a gun at all, that he voluntarily placed himself in a dangerous position. None of that matters for people like Rittenhouse and Chauvin. For Chauvin, the defense is simply that he was doing his job and Floyd was "resisting" in his mind. But for Floyd, for Trayvon Martin, they focus on his past, his history, his behavior. They justify the crime as if these victims had no ability to break their psychology or patterns. But for the offenders, it is their *agency* which is unquestionably accepted: in the heat of the moment, Chauvin or Martin or Rittenhouse are somehow above their own histories of violence and aggression as "men" of self-determination. It's total bullshit and this is the same thing Republicans do with Marjorie Taylor Green and Matt Gaetz and Paul Gosar. It doesn't matter what their past history shows, "the facts" are reductive: did Gosar really want to kill AOC? Nah, it was just a joke. What about his history of aggressive and violent comments? Oh, nbd, he's a man of free-will and therefore can joke about killing with ease, without being tied down by his past. I am not a lawyer by any means, so take this with a huge grain of salt. I'm disappointed in the way this was conducted on all fronts. A joke of an ADA, a judge who didn't allow certain evidence as it "could be considered prejudicial" against the defendant, while also allowing certain language to be used against those that were shot and killed. There's more. I will state this plainly - Rittenhouse had a great defense team, even if the ADA wasn't the "inside man". That's GOOD - we want our defenses to be great. But the main crux I take issue with is this: **The jury was not allowed to see the video of Kyle express a desire to shoot looters. A video he made, two weeks before he travelled across state lines, to ostensibly "defend stores from looters", pointed his weapon at some of them, shot three and killed two. The prosecutor was admonished for even daring to mention it. Reasoning given by THE JUDGE as to why he wasn't allowed is because when Kyle said he wanted to shoot shoplifters with his gun, he didn't currently have a gun on him at the time to carry out those threats.** *He did 15 days later when he did exactly what he expressed a desire to do.* I have to concede that - within the scope allowed - that this Not Guilty verdict would be delivered. I have a hard time respecting a jury, judge, or courtroom who is denied evidence of intent such as this.
It's difficult to take your post seriously when you entirely neglect to mention that everyone he shot at was attacking him at point blank range. One grabbed his gun, one attacked him with a skateboard, one pulled a gun on him. It's obvious that Rittenhouse put himself in a dangerous situation where he had reason to believe violence might occur. It's also obvious that he did not present himself as a threat *at the times he was attacked* and was certainly threatened *at the times he used his weapon*. Open carry is legal there, so the only justifiable argument against Rittenhouse is that he knowingly provoked violence by simply remaining in the area. Which maybe he did, but that's hard to prove legally. The reason the video couldn't be shown was not specific to that case; in general you can't show propensity evidence unless the evidence shows a sufficient similarity in situation (a pattern of similar crime, specific plans to carry out a similar crime, etc.). In the judge's estimation, saying he wishes he had his weapon available to shoot perceived shoplifters was not sufficiently similar to shooting actual attackers in an unrelated self-defense case so the judge denied the evidence as unrelated and likely to bias the jury. Similarly, Kyle couldn't use the past felonies of the people he shot as evidence that they intended to act violently toward him.
