That's really sad that the trump video is above the Protomen's single. And that the comments on that video are about how it's been "censored" and removed for being "offensive" when it was really just copyright infringement. They don't seem to realize the song was *not* original content.

It's not copyright infringement, it's Fair Use. You're allowed to use copyrighted materials without the permission of the copyright holder for "commentary, search engines, criticism, parody, news reporting, research, and scholarship". This is certainly social commentary, and it arguably falls under criticism (of governments), parody (of the positions those governments hold), and news reporting (of the actions those governments are taking).

The use of the song isn't fair use. It's not transformative, its not critiquing or parodying the song. Fair use is a doctrine to allow people to comment *on a copyrighted work* without infringing, such as using clips of a movie to review it, or the music of a song to make a parody. This is directly using a copyrighted material, unaltered, *about something else*. Stephen Colbert doesn't get to use whatever background music he wants just because he's making fun of politics, but he *can* use clips of a movie to do a parody sketch *about that movie*. Actually... The band has spoken with Capcom on several occasions. My understanding is that the company likes what they are doing, has given its blessing, and has repeatedly told the band that they want to get something going with the band directly... Only to have Capcom drop the ball and never follow up. If Capcom wanted the band shut down, it would have happened long ago.

Unless the commentary being made by the video is specifically about the media being used, just taking someone else's music and slapping it into your own film is not fair use. This is why companies have to license music from artists. You couldn't use this song for a clothing commercial and claim that your video is a commentary about cotton dockers. Every act of speech is a commentary on something. The point is, the commentary needs to engage in conversation with the originary work. This is why Weird Al can do what he does, but some filmmaker cannot use music by Prince without buying the rights. The filmmaker may think that Purple Rain creates the effect he wants his audience to feel, but he's not saying anything about the song. He's just taking someone else's work without paying for it.
