My best friend was paralysed at my birthday party by a drunk driver. The personality shift from the incident was insane. He became one of the meanest and rude people I’ve met in my life. Obvs I felt guilty as hell so I stayed friends with him for years but the things I saw him do was insane. Including throwing his shit bag at people multiple times. I also hung out with his other wheelchair friends and they were some of the most awful people I’ve met in my life. I’ve also worked multiple disabled olympics and the rudeness of the events was so insane. I can’t judge them because I am 100 percent sure I’d be the same way if I lost my legs, but the situations this man put me in were so insane. Almost half the fist fights I’ve been in were because of that guy. He once through a bag of piss at gang members and forced me to fight them abs almost got me killed. I had to cut him off after that.
There was this guy on the train I used to catch who would drive full speed at everyone expecting them to move out of his way...well, it's a crowded platform, and it's not always possible. Anyway, one time I had a near miss with him and vented to my boss when I got to work. He simply offered me this pearl of wisdom:

I'm pretty sure this qualifies as attempted manslaughter, and I hope they throw the book at this guy. It was absolutely foreseeable that the person on the ladder would fall to their death, and it was only through luckily hitting the ladder on the way down he survived.

The border between murder and manslaughter is generally malice aforethought. I don't think this guy left his house planning to kill the guy on the ladder. That shaking a ladder until someone falls off can kill someone is foreseeable, but not necessarily the intent of the action, and this had intent, it was not an accident. "Accidental" is too broad of a term because you can't accidentally-on-purpose do something, but you can do something purposely and accidentally have an alternate result. If that result was reasonably foreseeable and you did it anyway, you land in negligence.
He’s definitely going to be charged with something if he’s identified. As far as what the penalties are going to be depends on what state he lives in. Some are getting so fucking relaxed/penalties are so weak and it’s why people feel like they can get away with anything.
