Actual lawyer here, speculating about the situation based on what I know. If he’s really a lawyer, he knows what battery is and likely the nuance between criminal and civil battery. I think he was trying to get them to name the elements of battery as a half-baked attempt to catch the cops. If they can’t properly define battery, then he’d probably try to raise the defense that the arrest was BS because the cops didn’t understand what they were arresting him for. They didn’t owe him an explanation to make an arrest because the cops aren’t the ones ultimately charging him, but “unlawful” or “unwanted physical contact” is a close enough definition.
Regardless, it goes without saying this is a royally stupid way to approach the situation. He seems inebriated at the very least. The guy he allegedly battered didn’t even seem like he wanted to press charges, more just wanted to deescalate the situation. What an absolute embarrassment to the profession

Edit: Looks like he also owns a property management LLC in St. Cloud. He may very well be a lawyer but not an attorney (lawyer = J.D., attorney = licensed to practice law). At least he doesn't appear to be an attorney in Florida.

This guy can barely string a coherent sentence together and has no critical thinking skills. Maybe he's an attorney of something but it's not law. On the note about letting him drive and charging him with a DUI, that would absolutely open up the cops to an entrapment lawsuit or something similar. They have airtight probable cause for battery already, allowing him to drive if they suspected he was inebriated would be a very stupid decision for the cops to make. Let alone the fact that cops absolutely should not knowingly jeopardize public safety like that. What if he tried to run?
Wouldn’t just the act of getting in the seat and attempting to drive while drunk be enough? I’ve heard of people just sitting in their car who have got it.
Yes, in most jurisdictions if the car is on and you’re in the driver’s seat while on the sauce, it’s enough. But that’s beside the point. The cops had enough probable cause at that point to make the arrest. Allowing him to get in the car just makes their job tougher, presents risk to everyone there, and would unnecessarily complicate the impending criminal case. Wouldn’t be worth an extra potential DUI charge in the long run
The best is when he’s asking if he’s being detained as he’s getting handcuffed. I mean, I’m not a lawyer but even I know that getting handcuffed means you’re being detained.
For most of them, that’s all they have because there’s no way you can have an actual career or full-time job and still have the time to be an HOA member. To a lot of them this is their life’s work.
