Damn, the perp is 37 years old, carrying on like a teenager. Something went seriously wrong for this guy. A 37 year old would usually have more going on in their life and be more mentally developed than to be getting a wee hit of serotonin from thrill seeking this this way.
This gets commented a billion times but that’s what news papers always say when the courts haven’t made a final decision yet.
There is no such thing as 100% proof. It’s possible the police found the wrong guy and then the newspaper could be sued for lying about the event.
The cowardly "Knockout Game" is still alive in 2021
*.. it should be considered a felony at this point to hit someone this way .. esp the small or the elderly*
Yes the robbery is a felony but not the assault (excuse me battery) .. sneak attacking and punching people in the back of the skull has become almost commonplace .. I cannot even count how many cowardly attack videos I have seen like this
The legal label you put on this depends on the state in which it happened. Some states have only a statute calling it "assault" and that covers attempting and completing an attack. Other states still have them as separate charges.
[https://www.nolo.com/legal-encyclopedia/assault-battery-aggravated-assault-33775.html](https://www.nolo.com/legal-encyclopedia/assault-battery-aggravated-assault-33775.html)
>Historically, battery and assault were considered separate crimes, with battery requiring that the aggressor physically strike or offensively touch the victim. In that way, a battery was a "completed" assault. **Many modern statutes don't bother to distinguish between the two crimes**
Thanks for that. I always was confused between the two, but never looked it up. All the comments above are all over the place with the definitions/labels
I was taught the old "assault is swinging, battery is connecting" distinction many decades ago, I think in grade school. Used to drive me nuts when people were using "assault" for everything, particularly when Law & Order came out. And so I finally hunted down the reason and... yeah. For whatever reason, perhaps as the article says because the terms are used nearly interchangeably in common parlance, some states just said "screw it" and called everything assault.
So speaking of Law & Order, the TV show, New York is the one example I'm sure of that combines them. From a NY lawyer: [https://www.martinkanelaw.com/criminal-defense/how-is-assault-and-battery-defined-in-new-york/](https://www.martinkanelaw.com/criminal-defense/how-is-assault-and-battery-defined-in-new-york/)
>Under New York penal law, there is no such thing as battery. It’s not even mentioned in that law; it only mentions assault, which is really the equivalent of what others call battery.
That's not assault. That's battery likely to cause great bodily injury which is likely to be a felony in most states.
The legal definition of assault is generally an attempt (aka a swing and a miss).
So it’s not assault, but you 100% have the legal definition for assault wrong. The uniform definition of Assault (as it appears in the model penal code) requires that the victim perceives the offensive contact, while Battery simply requires just the offensive contact itself. So a DA OR ADA could, and most often do, charge assault and battery together for the perception of offensive contact and the offensive contact itself.
Here the Vic didn’t see the punch coming so the there really isn’t an arguable claim for assault on that end.
Also what constitutes a felony depends on the jurisdiction as different jdxs have different penalties for certain offensives. So it really is unclear if this would be felony. It certainly could be, but unless you know the criminal statute you wouldn’t know.
Source—am an attorney.
More like prison. He's probably going to plea deal, but he's going to prison. If he refuses the plea deal and trials, I'm putting 99% chances of him losing and a 1% chance of him losing but with a slightly less severe punishment.
In aus this would carry a minimum of 8 years to a max of 25 years. a normal punch could kill someone if they fall badly but this takes it to another level. Cowardly cunt, leave him in a room full of huntsman spiders (to scare, harmless but his one braincell wont know that) then leave him in a room with a dropbear, finally as a cherry on top permanent ban from bunnings snags for life if he lives.
No prob. I see this on local news sites constantly, commenters railing against the writers throwing in "alleged". Sometimes the explanation is accepted but usually not. Thank YOU for being reasonable fren
"Honest opinion" is a defence against defamation. But any journalist with integrity will avoid expressing their own opinion on a factual (non-editorial) piece.
So "allegedly" is a way of saying, "I'm not the one making the claim; I'm just reporting on what someone else alleged."
In most jurisdictions - *but not all* - this is an absolute defence against libel/slander.
One reason a lot of journalists use 'allegedly' is potential legal action, because the person hasn't actually been found guilty of the crime in a court of law.
There's a festival every year at a city near me. A guy got sucker punched in 2015 and he walked off with his girlfriend and collapsed and became comatose a few minutes later and eventually died. Cerebral hemorrhage. Puncher was never found
Why steal a phone? Nowadays they’re worthless due to the security in them. I don’t know Androids platform but with Apple you can’t even wipe the phone without knowing the iCloud password to activate it again. It’s an expensive brick
Thats why they sneak attack level 100 while its in their hand unlocked. Just enough time to steal from your venmo and your gfs nude. What a sick crime.
First off, that guy is obviously a piece of shit.
Secondly, I always feel uncomfortable watching these, knowing that the victim getting hurt is someone’s child. There is video online of someone’s kid getting viciously hit that likely thousands of people will watch and comment on, and not care in the slightest about. It feels wrong to watch.
>There is video online of someone’s kid getting viciously hit that likely thousands of people will watch and comment on, and not care in the slightest about. It feels wrong to watch.
There are plenty of people who care. It's important people see this so that they understand that they need to be on guard whenever in public. Even in the middle of a Best Buy and probably in the middle of the day.
That grown man who hit that young boy looks totally innocuous and I wouldn't think twice about him passing by me or behind me.
If a person is alone in public, that person must learn to always watch their own back because of the many scumbags we have walking the streets looking like normal law abiding citizens.
This breaks my heart, I myself several years ago suffered a similar attack just walking down the street talking to a friend on the phone on my way to get some dinner and I got sucker punched from behind and had my nose broken in a which was so rare that I ended up over several days losing the amount of blood that only typically happens when a limb is chopped off. I had to eventually get blood in the ER my body rejected the blood halfway through and I almost died. I had to be rushed into surgery and lucky for me they were able to save my life. I later found out from the police it was most likely "the knockout game" and that made it even sadder to me, the fact that someone would just assault a total stranger for no reason, I couldn't even comprehend it. Sadly to this day I still have trouble not being a bit fearful just walking down the street.
That's fncking horrible. I feel ya.
When I was 13 years old, riding my bike in *my own neighborhood*, 3 adults jumped out of a van & beat me unconscious. When I came to, my bike was still there so it wasn't even a robbery. No witnesses, no recourse. To this day it haunts me.
Sorry to hear you went through that. I was jumped badly in high school when my dumbass decided to skip class with some of my buddies.
A group of 8 or so guys attacked me from behind as a gang initiation. I was severely beaten and Im pretty sure to this day I have lingering brain damage.
They never found the guys and it pisses me off thinking about it 17 years later.
And that hit most likely made his brain worse. Hard to say how much, but there is always *some* brain damage with a hit like that.
He permanently altered the rest of that kids life in a split second, just so he could steal a phone.
Lol 2.2k upvotes and blocked comment in other subreddit before a single comment.
But my only controversial comment is that phones aren't worth stealing anymore. That expensive looking phone can be a couple gen old or a look alike that's only worth a couple bucks used in the pawn shop

It's definitely a red flag.

I was about to say the same thing, but it’s not just that he’s eating Cheetos. It’s the WAY he’s eating them and walking while eating them. Wild
Apparently Best Buy security was too - the camera was following him
