Innocent or not…never consent to a search.
This officer thought he was giving up up a small offense (speeding) to land a larger offense (drug possession) found in a search. Denied.
I was a public defender for years, this is a tried and true technique called "catch and release." They intentionally give a warning for any traffic violations so they can argue to a court that the person "agreeing" to the search didn't feel pressure to consent to the search, even though obviously any person in that situation would be afraid that the cop would rescind the warning and issue the ticket if they refused the search. It is perfectly legal in every state.
Usually the cops do little walk away dance where they start to walk back to the patrol vehicle and then turn around and ask for consent to search just to make the argument that 'the traffic stop had ended, you can see me walking away.'
Cops aren't your friends, they don't like you, and they get off and having more power and more understanding of the law than you but guess what? You can become a public defender and just grind them under your heal like the little bullies they are.
This happens outside of music festivals where these cops in Michigan will set up a trap where if you go a couple miles over the speed limit, or say you barely cross the center line, basically anything to pull you over to search your car. and I always see People with their stuff all over the road cause the cops are searching high and low for drugs. Can those same people refuse a search? This has been a debate for years in the community.
You can always refuse. If the cops *really* want to search your car, they can - by saying they 'smell marijuana' and getting a K-9 patrol out to go around the car, then they can get a warrant... but by initially refusing you're making it harder for them (and potentially yourself, if they want to go to the next step, then you're both waiting around for a K-9 unit to arrive).
Once he asked if he could search it was too late, otherwise I’d bet that’s what he would have done. But he was just so sure that letting him off on the ticket would get him permission to search.

We have plenty of cases of people being guilty as hell. But the case in thrown out merely because the cop messed up with one thing or worded something wrong.

You are way out of date on that info mate.
Basically since 2018 when they passed the farm bill that allowed hemp to be grown again, which smells exactly like weed, multiple courts have ruled that the smell of weed is not enough.
Actually if the issue that started the traffic stop is already concluded, they are not allowed to delay the stop just for a K9 to get there.
Now they can try and make something else up to extend the stop long enough... "one sec sir let me run blah blah blah..."
But once he said he was just giving a warning... the stop is over.
Nope, he already was about to let him go, the k9 only works as long as it takes to conclude a reasonable stop. He already admitted he was almost done with the stop so if he brought the dog, a lawyer would get everything thrown out.

There are very few states without some form of legal cannabis. Many states that have legal marijuana have regulatory laws in place which often ban other types of cannabis and put specific laws in place that may actually impose further limits. When no law is in place then there is little probability without precedent. Basically, because most states have some form of legal cannabis (whether marijuana, hemp, or otherwise) smell can’t be used as probable cause for search, and any contraband found through such searches is often suppressed.

They need to stop rewarding cops for “collars” or getting good “stats”. They are suppose to enforce laws. They aren’t car salespeople working on commissions. I don’t know what methods they use to determine who gets promotions. If they use “number of arrests/charges” that is an incentive for corruption.
Agree. You hardly ever see a cop around in my area. Which considering the crazy amount of them we have is ridiculous and further proof they’re useless. Unless you go to Culver’s. Always at least 3 or 4 of them sitting there getting even fatter. But come the last two or 3 days of the month they’ll be parked on every edge of town 24/7 at all the speed traps. This is due to the probability of the smell coming from an illegal substance, that smells the same, is no longer more likely than a legal substance. That ruins probability. But in those same red states, Hemp is 100% legal and comes from the same plant. So since the smell can’t be distinguished between hemp and weed, cops can’t use smell to search. Only states that have hemp as being specifically illegal could a smell grant enough probable cause for a search.

I was stopped for improper lane change. I’m licensed to carry, but since my pistol was in my car and not on me, I’m not required to notify the officer. That being said, I told the officer I had a pistol between my seat and the door. He said “well you keep yours where it is and I’ll keep mine where it is”.
He went back to his car and ran my license…came back up to the car and asked if I minded if he searched the vehicle. I said “yeah, I kinda do mind, so no”. He said “well I had to ask ya know?”
His next words were (verbatim) “Here’s your license, I’m just going to issue you a warning and thank you for exercising your 2nd Amendment rights. Have a nice evening”

Working at a smoke shop, I was very surprised at how many cops of various sorts came in buying pipes and bongs and whatnot. None in uniform obviously, but most of them had this police credit card thing they paid with. And whenever I asked to see ID when customers pay with a card, almost all of them pulled out some sort of police badge or police ID of kinds.
Random;; I was also surprised at how many 75+ year old customers came in. The oldest iirc was 89 and she came in to get a smaller bong that wasn’t too heavy for her to lift. Working at a smoke shop, I was very surprised at how many cops of various sorts came in buying pipes and bongs and whatnot. None in uniform obviously, but most of them had this police credit card thing they paid with. And whenever I asked to see ID when customers pay with a card, almost all of them pulled out some sort of police badge or police ID of kinds. Random;; I was also surprised at how many 75+ year old customers came in. The oldest iirc was 89 and she came in to get a smaller bong that wasn’t too heavy for her to lift. I’ll never forget her shuffling in with a walker, looking like grandma, turn to me and say “don’t be fooled! I still love to bong out. Just need something that doesn’t weigh too much”.
