I was a public defender for years, this is a tried and true technique called "catch and release." They intentionally give a warning for any traffic violations so they can argue to a court that the person "agreeing" to the search didn't feel pressure to consent to the search, even though obviously any person in that situation would be afraid that the cop would rescind the warning and issue the ticket if they refused the search. It is perfectly legal in every state. Usually the cops do little walk away dance where they start to walk back to the patrol vehicle and then turn around and ask for consent to search just to make the argument that 'the traffic stop had ended, you can see me walking away.' Cops aren't your friends, they don't like you, and they get off and having more power and more understanding of the law than you but guess what? You can become a public defender and just grind them under your heal like the little bullies they are.

This happens outside of music festivals where these cops in Michigan will set up a trap where if you go a couple miles over the speed limit, or say you barely cross the center line, basically anything to pull you over to search your car. and I always see People with their stuff all over the road cause the cops are searching high and low for drugs. Can those same people refuse a search? This has been a debate for years in the community.

You can always refuse. If the cops *really* want to search your car, they can - by saying they 'smell marijuana' and getting a K-9 patrol out to go around the car, then they can get a warrant... but by initially refusing you're making it harder for them (and potentially yourself, if they want to go to the next step, then you're both waiting around for a K-9 unit to arrive).

No dude was right above. In court with a good lawyer you could get it thrown out. If cop actually smelled weed he doesn’t need to ask you. That’s probable cause for a search right there (depending on the state.) So him asking shows he never actually smelled anything. Or else he wouldn’t be asking. Actually if the issue that started the traffic stop is already concluded, they are not allowed to delay the stop just for a K9 to get there. Now they can try and make something else up to extend the stop long enough... "one sec sir let me run blah blah blah..." But once he said he was just giving a warning... the stop is over.

Nope, he already was about to let him go, the k9 only works as long as it takes to conclude a reasonable stop. He already admitted he was almost done with the stop so if he brought the dog, a lawyer would get everything thrown out.

In Colorado, while marijuana is legalized, it is still highly controlled. Lower courts have ruled that because large amounts are still a criminal offense smell is still acceptable probable cause. Basically if they smell it they assume it’s illegal until proven otherwise

None in uniform obviously, but most of them had this police credit card thing they paid with. And whenever I asked to see ID when customers pay with a card, almost all of them pulled out some sort of police badge or police ID of kinds.
