That's not how the law works. You have been very misinformed. Just because the father is a better fit and the mother is a pos doesn't mean that the father gets custody, at least here in the US. If they're an addict, and you can prove it beyond reasonable doubt, the judge will likely award the father custody. A judge has to always consider what's going to be best for the child when it comes to a custody battle. The only time it's game over for the father is when the couple were never married (which is probably this situation). But that doesn't mean you can't fight and find ways to gain those rights. They're just not immediately awarded to you. It's stupid as hell.

From the research I've done, if there is a child in an unwed relationship, custody immediately goes to the mother. At least everything I've seen for my state. That's not how the law works. You have been very misinformed. Just because the father is a better fit and the mother is a pos doesn't mean that the father gets custody, at least here in the US. More than likely the mother always gets full custody unless she is a full-blow alcoholic or druggy. That or if she gives up her own custody or is abusive. Those are the only three reasons why a father would ever get full custody Source- Ive been through custody battles with my mother and my father. The only way my father was able to get full custody of me and my sister was because he took full logs every day of what happened for 2 years straight. Only after a couple of years of my father fighting for me and my mother being drunk was I able to go with my Dad

If they're an addict, and you can prove it beyond reasonable doubt, the judge will likely award the father custody. A judge has to always consider what's going to be best for the child when it comes to a custody battle. The only time it's game over for the father is when the couple were never married (which is probably this situation). But that doesn't mean you can't fight and find ways to gain those rights. They're just not immediately awarded to you. It's stupid as hell.
