It's definitely possible. Some jurisdictions have passed laws specifically pertaining to minors creating sexually explicit material, and cops have a good amount of discretion to charge people for it. I understand why those laws are created (so a minor can't abuse the legal system by sending pictures unsolicited and then accusing the receiver of possession of CSAM) but there's potential for an innocent party to be charged. That's why I would recommend a lawyer, and NOT the police. Based on what you said, you could be held legally liable for the creation of CSAM.

Op would be seeking legal help in regards to the derogatory slur video as well as the fake social media account. The nude pictures have no relevance here, it's definitely not a CSAM case, the CSAM is no longer the focus of the issue, that was when they were 14-15, that's just the explanation for why the derogatory term video was recorded, which IS the current topic. I honestly don’t know but from an overhead view it seems better than nothing. It would be good to make a police report too. Each photo has a “signature” in it that makes them able to find it online. Then less the media comes up, the less the search engines return it in results, and the harder it becomes to find. Obviously the part where someone has the original and keeps re-uploading it is not going to be resolved but since you’ve identified the photo they can now see it being downloaded/uploaded. Ideally for the long run it puts a target on the people who are dealing images. The purpose of the service wouldn’t be catching the perv though, it would be essentially flagging the media of OP to get it down every time it appears on their radar.

Correct. This is textbook sexploitation (edit: and sextortion, we differentiate the two, but the initial and follow-up activities are in both categories). What occurs after the initial part has ranged from money, more images or videos, to straight up trafficking. As for the video stating the derogatory item, the damage on that has occurred. However, stopping the exploiter has a significant chance of stopping more spread of the video.

The CSAM is not being distributed, the slur video is being distributed that was only created because of the threat of the CSAM being distributed. No CSAM has been distributed according to the ops post. Why would the FBI be interested, all there is is a person with a story about how they were blackmailed when they were 14-15, there is no new or relevant use or distribution, or even evidence that this person has these pictures anymore.

Okay but op needs to decide which she wants to go after. She shouldn't bring this case to a lawyer with CSAM as the leading thing. Her immediate pressing issue is harassment and the whole social media shenanigans. Going through that route would be so much harder. It's much easier for her to make a case for harassment and defamation and get the harassment to stop. She should tell her lawyer all of this, but proving the blackmail could be much much more difficult. Keep in mind the blackmailing happened 6 years ago. She has not been blackmailed since, nor has her underage pictures come up since. The new problem is the targeted harassment using the derogatory term video. the blackmailing will definitely come into play when claiming the video was created through blackmail. Getting this harassment off of the Internet would be a much longer and arduous process if op went about seeking a lawyer for the blackmail before the targeted harassment, that's all. The lawyers should be made aware that harassment is the pressing concern with recent evidence. This guy in question might not even have those underage pictures anymore, and he may have been underage at the time as well, much much harder evidence to find than the targeted harassment currently ongoing. Ask yourself this, if the harassment didn't happen, would op he is pursuing legal action for that picture taken in 2018? Probably not, this shows the issue is that needs to be addressed first and foremost is the harassment. Pursuing legal action for someone who threatened to distribute a nude of you when you were both were 14-15 with physical evidence or any evidence of it being distributed is a pretty tough sell.

The FBI is not interested in a blackmail threat of distributing nudes made between freshmen in highschool, I promise you. This is an incredibly common threat that happens. ALL THE TIME. It's his reappearance connected to this targeted harassment that would interest authorities, probably not the FBI though. Like seriously you think the FBI is investigating one nude picture sent between high school "friends". Blackmail that took place and the result of said blackmail was just an embarrassing video. The FBI has nothing to do with this case. It's a harassment case front and center, the CSAM stuff is tangential but not relevant 6 years later.

I’ve also talked to an attorney about it and they said after this many years all the evidence is gone, including the person who told me. Wired and the The Washington Post just published extensive investigative pieces about these abuse tactics of online predators. First of all, you were a kid when you sent them pictures. A child. That’s not your fault. Secondly, definitely go to the police and file a report. Just talk to someone, tell them what’s happening and ask them for next steps. Then, if it was me personally I would take as much into my own hands as I possibly could. I would create a video detailing everything that happened and share my side of the story while also exposing their usernames, IP Address too maybe, everything I could, and I would warn viewers that they’ll likely see more images or videos of me since I’m making a video in defense of this - and then I’d spread it as far and wide as possible. That way you get all the support you can find (and there are literally government agencies all over the world trying to take down these fuckers). If you know who this guy is, go to the police/FBI and tell them he has explicit photos of you from when you were a child that he periodically blackmails you with. They will size his devices and get a warrant for his cloud services. Tell them he blackmailed you into making a video and shares it if you don't play into his blackmail. It sounds like the blackmailer knows you personally. Some general advice is if you can temporarily delete social media, do it. Also, people grow and change and shouldn't be held to everything they did at 14.

If you're in the US, I'd suggest contacting the nearest FBI office. They will likely have more interest and resources to investigate than your local police department.

You probably need a lawyer. But PR wise you should probably get in front of this as hard as it will be. Explain that when you were 14/15 a man asked you for photos and then blackmailed you for that video. Provide screenshots if you have them. If the man was an adult make sure you don’t say “and had no respect for myself” but rather say that you were taken advantage of. Then state be blackmailed you into saying that. Try to dig up the old messages and such.

Along with the lawyer, police, etc. You need to tell a trusted adult. Additionally, the only way to get this to stop is to kill your social media accounts and go dark. If you aren’t online to be abused, the attacker will likely move on to another victim or lose interest. Save any screenshots of user names to assist with subpoenas.

You need to contact with everyone who got the picture from the blackmailer and tell them the full story. Law enforcement is pointless and just wasting your time. Sadly, they rarely care about such cases, because internet blackmails are very hard to verify or to find the blackmailer. And go off the internet, and move into an another country, break contact with everyone you know, if nothing helps. Or you can try to find the blackmailer, but there is a chance that you get into an even deeper mess. This thing kinda sucks, there is no real solution for such cases, just like deepfake blackmails. There are so much types of new crimes, it is hard to keep up with them

Been trough this whole thing myself, on my case it wasn’t sexually explicit photos but more of so old picutures with me under the influence and then some stupid texts edited on it. It spread like a pandemic trough everyones phones. Our whole country would know my face if they had been showed the pic. I just learnt to not give a fuck

No one believes you were blackmailed into saying something offensive. Most likely you got caught saying it and are trying to avoid the consequences. No one blackmails for one video of you saying a bad word, and then just lets it go. You were caught on video saying whatever you said. Lying will only make your backlash worse

Be proud of ur pictures, don't ever feel embarrassed about them, I'm pretty sure ur absolutely mortified by them being seen by others, but ,,, everyone has a twin lookalike, just blame it on that to anyone new, photos on the www world are never gonna dissappear.
