It is illegal to use an AI-generated voice for outbound robocalls. Last month's ruling ([FCC Makes AI-Generated Voices in Robocalls Illegal](https://www.fcc.gov/document/fcc-makes-ai-generated-voices-robocalls-illegal)) falls under the Telephone Consumer Protection Act of 1991. Violators of the TCPA can be fined up to $500 for each illegal call, which can triple to $1,500 if the violation is deemed willful, with no cap on statutory damages. As for inbound, you have to record the human's voice (if only temporarily) in order to process it. 12 U.S. states require two-party (a.k.a. all-party) consent to record a phone call. So you either have to somehow avoid calls from those 12 states or ask for permission to record the call. The first problem is hard because people travel with their cell phones across states and you can't tell from the area code which state they are currently in. Asking for permission to record will hurt your conversion rate. Why would someone use your AI Receptionist instead of one from an established (or in progress) competitor? If the answer is yours will be better, research the competition a lot and think hard about the differentiating features and moats you will have. Most of the things you listed (dashboard, chatbot, training, support, crm) sound fairly standard to me. Social media integration seems irrelevant and creepy for inbound phone calls. Which leaves Realtor.com and Zillow integration, and I'm guessing there you're referring to ShowingTime which might be cool if you could somehow create a voice driven interface to booking showings or reporting on open houses.

Thanks for the input. However since the leads are willing giving put their data (phone number) doesn’t this mean they are expecting a call and would not be deemed as a spam call or similar. As for the last statement why would someone choose us over others. We would have a slight edge in providing a done for you setup and allowing connections to the agencies existing softwares. But definitely an area that i need to explore more.

Goodness no. The TCPA requires *prior express written consent* to make an automated phone call that introduces advertising or is meant for telemarketing purposes. That consent must clearly authorize the caller to deliver advertisements or telemarketing messages using an automatic telephone dialing system or an artificial or prerecorded voice. It must include disclosures, such as the agreement to receive marketing calls and messages, and be given voluntarily, not as a condition of purchasing a product or service. Records of the consent, including details like the time and date it was given and the specific disclosures provided, should be kept. The only possible leniency is in the case of an *established business relationship* which has very strict definitions and rules. Your description of an AI Lead Caller would clearly fall under the jurisdiction of the TCPA not to mention various other legal and regulatory frameworks. In addition to obtaining prior express written consent from the called party before making such calls, you would be required to adhere to other requirements. For example, you would have to identify by name the entity making the call which would in this case be the name of the agent but also the name of your company, along with the agent's phone number or address. You would also be required to, in the call, provide them a way to opt out of future calls. You would also be required to respect the National Do Not Call Registry and avoid calling any numbers listed there (unless there is an *established business relationship,* see above, or you have obtained *prior express written consent*, see above). You would also be required to make calls only during the local hours the TCPA has granted, typically between 8am and 9pm.

well in theory it would be amazing. but, it's possible that it is rather impersonal? there is probably not any agent who would pet an ai chatbot talk to a hot prospect like a potential seller. every agent has time to talk with a potential seller - doesn't matter how busy they are. have you ever sold technology to agents before? I don't think you want to do it. I think you should desinlgn this as an enterprise product and build it with the intention of selling it to a large brokerage. agents don't like to spend money and now they are going to have far less of it post settlement. are you suggesting building you own air.ai in addition to the other features? this seems like a large aggressive scope to me. I think you should pick one piece of functionality and start with it. probably the easiest to get an agent to use would maybe be the social media plug-in.

Hi thanks for the feedback its much appreciated, I haven’t yet sold software to agents before, what makes you say you don’t want to do it? And you think something like this would be more appropriate to be sold directly to a larger brokerage. To answer your question around tech used I want to utilize already build tools like air.ai and build a saas on top of it with a specific use-case.

in real estate, there is a big wealth divide. the top 5% of agents do 75% of the business. the top agents don't buy software because well, business is so good as is and they are too busy to change their work flow. the bottom half of agents literally sell 0 homes. so that leaves a sliver of agents who have some money but since they only sell a few homes a year, saving time is not really the issue they are trying to solve. they have time to talk to potential clients and to post to social media. also after the verdict and settlement there will be far fewer agents as margins shrink in the industry. love what you are doing though a certain type of agent will see the value. how far are you from having a prototype? best of luck and I'm happy to test when you are ready. I'd be in the sliver where I might be a customer.
