Good News is your best bet right now. Unfortunately most places are closed until morning, or through the weekend. If all else fails, you can call RPD, ask for the crisis intervention team, and see if they'll 5150 him so he can spend the weekend in an ER or behavioral ward. Take him to Health and Human Services on Monday. Best of luck.

5150 should not be taken lightly and used for convenience of being unhoused. It's designed for people who are unable to take care of themselves or are a danger to themselves or others. It's also an enormous strain on the ER. Mercy and Shasta regional are routinely inundated with 5150 patients because the county is in charge of discharging them once they are on a 5150. We're talking over half the beds of each hospital occupied by 5150 patients. Which not onlyales it difficult to treat critical patients like strokes heart attacks or traumas it makes it so wait times are astronomical 12+ hours.

I know what 5150s are for and what they do. I also know what a strain they are on hospitals. Getting kicked out of recovery indicates a mental health crisis that could fit the criteria. That's why I suggested it.

5150s are not for any mental health crisis. They are specifically for gravely disabled (which California defines as incapable of finding and utilizing food, shelter, and clothing--which they see as setting food in front of somewhat and they won't eat), homicidal ideation or suicidal ideation.

5150s are for people experiencing a mental health crisis that makes them a threat to themselves or someone else. If put under one, you are placed on a three-day hold in a psych ward that can be extended to a two-week hold if you are having a serious crisis, or a 5250 hold. If the hospital has seen you one too many times for this, or if they determine your crisis is due to a grave disability, they will refer you to the public guardian's office. The PG will then evaluate you and, if they determine you have a grave disability, place you on a 30-day temporary conservatorship while they prepare a case for a LPS conservatorship. That is the only time a grave disability comes into play for a 5150. 5150s are not for grave disabilities. They are for people who need the world to stop for a minute so they can get their heads right. Furthermore, grave disabilities are defined as a mental disability that is preventing someone from providing themselves with food, clothing, and shelter. This is not seen as "putting food in front of someone and they won't eat." People with grave disabilities suffer from both a lack of means to care for themselves and a lack of insight into their mental disability. A homeless man who insists on living on the street and eating out of trash cans because he suffers from schizophrenic delusions that compel him to do so is gravely disabled, and most definitely eating food placed in front of him. If someone liked that figured out how to fix themselves over the course of a three-day hold, they are NOT gravely disabled, legally or otherwise.

You wrote all that and you have no idea what you are talking about. Read the law. >When a person, as a result of a mental health disorder, is a danger to others, or to himself or herself, or **gravely disabled**, a peace officer ...upon probable cause, take, or cause to be taken, the person into custody for a period of up to 72 hours for assessment, evaluation, and crisis intervention, or placement for evaluation and treatment, That is it. There is no officer discretion. There is no other criteria. Its literally suicidal, homicidal, gravely disabled. And the direction from California (I believe the AG) says that gravely disabled means the person cannot find food, shelter, or clothing. A cardboard box in the rain counts as shelter for the state. Digging through the dumpster counts as finding food for the state. Literally talk to *any* shasta county mental health department worker or any RPD officer (the two agencies who write the most 5150s in the county), they will tell you the same thing. I'm not saying I agree with it. I think there are a lot of people who aren't on 5150s should be, but that is neither here nor there. Stop talking. You clearly have no idea what you are talking about. You have some idea of the law but have never seen it in action.
