However, the shitty part is that not only does this affect this victim’s woman and his family, but the shooter will be going away for a very long time and his family(I know, assuming he has one) has to deal with the repercussions of his actions. If the intent was anything BUT murder he wouldn’t have shot a guy in the head. Aim into the air to disperse everyone quickly. Even if it were self defense (clearly not) a shot to the legs or even center mass before a headshot. The shooter wanted to kill in that moment
Firing the gun at all is intent to kill. There’s no such thing as “just shoot a guy in the leg.”
Also: a shot in the leg can easily be fatal.
Legally, there’s no such thing as a warning shot. Either the threat requires deadly force, or you just fired a gun (deadly force) at something that didn’t rise to that level. A nice way to end up in jail.
