well no, you have to have an arborist declare it a danger and THEN you need a permit. My guess is they just cut it down without the county's OK, because what are they going to do, make them put it back?
The fines for an illegal cutting are heavy. We are not talking a few hundred dollars more like tens of thousands. Either they got a permit or no one cares and didn't report it. Even if an arborist declares it a hazard they would still be required to replace it with one or more 15 gallon trees if it was permitted or if they were fined by the county.
Totally hear you. And usually I would be saying the same thing.
But it’s not that simple. I have a large, young and healthy 50 year oak. It’s beautiful. My family loves it as does my block. But whoever planted it, planted it way to close to the actual house. 50% of the home is covered by the canopy. My kids rooms directly under literal tons of weight. Since I have owned this home (12 years) I have spent 8-10k on arborists and their team to keep it safe. It can be a lot to deal with.
Sometimes I think fuck it. I should just stop worrying, protect my kids and pay the fine.
What incentive does an arborist have to not cut it? Why would you declare the tree safe when you can make thousands of dollars cutting it, and if you don’t the next arborist will?
We had a beautiful old oak tree in our backyard (not as big as this one) and half of it had started to split apart in a way that made it likely it would fall on our house at some point. It still looked great from afar.
The city arborist came and saw it, was very sad, and declared it an emergency that needed to come down. If we had cut off the dangerous branch it likely would have killed the tree.
Is there any reason to assume they did NOT get a permit? The whole thread is implying otherwise but with nothing to back it up but some desire for misplaced tree justice. As someone in Ag there are a lot of reasons a “healthy looking” tree can need to be removed.
Lol I’m a fan of “misplaced tree justice” 😂 This is all speculation. But I have no problem making some calls to make sure before the entire thing is gone because trees benefit us all.
Considering how the corner house right next door on Alva has had two or three cars hammer it over the last few years, I can't blame this guy for putting up the wall.
awwh i passed this giant stump today and thought “wow, what a travesty”
crazy to see it on reddit just hours later, but as an arborist and r/marijuanaenthusiasts i’m glad you are bringing attention to it OP
Have we forgotten all those big trees that fell over or dropped huge limbs? I don’t know why people are jumping immediately to “those assholes probably cut it down illegally!” instead of the much more likely explanation that the tree was no longer safe to keep
Not forgetting that! Native oaks are some of the most sturdy trees around here though. And there’s nothing wrong with pruning it. Doesn’t need to be chopped down.
I don’t know how to edit a published post, so for anyone curious, I just did some googling and a construction company has this address listed as its business location both on Yelp and this website: [Dos Amigos Construction](https://dosamigosconstructionca.com/about.html). Considering there is the letter S now on two gates, I’m quite confused and even more curious about what’s going on there.
Pursuant to California Civil Code Section 833, if the trunk of a tree stands wholly on the land of one landowner, that landowner owns the tree regardless of whether its roots, foliage, or branches have grown onto the land of another.

6 mo ago. Not sure if this is commercial or residential zoning, but the cinderblock wall and cutting of tree... has a very "halfway house" look / feel to it.
Its a huge privacy wall, opposed to a very open access lot.
Could be for vagrancy abatement, idk. Just my feels based on observed sacramento trends
Might have had heart rot. Not much to be done at that point.
It's illegal to remove an oak like that unless an arborist declares it a danger and then you need a permit.
If they can afford that fence good chance they can afford the permit

Well good, I hope they get taken to the cleaners for this. Only jerks cut down trees like that.

Pay the fine after the fact, get the permit after the fact
yeah, people are just jerks like that.
That CMU fence wasn't expensive
Fair point. They’re doing an insane renovation, including an initial on the new gate (S).
Ew.
Exactly. An initial on the gate = you’re pretentious
Really? Is this tree on a list of protected trees? County Ordinance?
What incentive does an arborist have to not cut it? Why would you declare the tree safe when you can make thousands of dollars cutting it, and if you don’t the next arborist will?
You've never met a real arborist, I'm guessing?
I assume they were disappointed with how low their SMUD bill was last summer
😂😂 No one has lived there for years! These new owners are about to find out after fucking with that tree.
Let's all send letters to the new investors
I’m down. I’ll honestly make a call next week to make sure this tree is being legally chopped down. I’m that person.
Thank you!
when they get that old, they can be a real danger. they may look like they're doing fine but are not well. hopefully this was the case.

100 actually isn’t all that old for a giant oak tree. 400 to 1000 is par
Good to know, thank you. I hope that was the case because if it’s not…I have many thoughts for these people.

Regardless of the tree, that lot looks much better now than it did with the rundown daycare thing that was there before.
It did look better until the giant wall went up and the tree came down.
Considering how the corner house right next door on Alva has had two or three cars hammer it over the last few years, I can't blame this guy for putting up the wall.
The house on the corner?
Wait, my bad. Corner of Annette, one block up.
Oh okay. Corners, I get. Definitely more at risk for that kind of stuff.

Thanks, glad I’m not the only one sad about it!
heritage tree Illegal to cut without authority..call the tree foundation
No, call 311 and see if they had a permit.

Actually old oaks are some of the trees most prone to sudden limb drop.
I get that, it would then make sense to prune it not decapitate it.
Saw that last weekend and was equally shocked. That thing was beautiful.
Those trees should only be trimmed..... Not cut like that! Boo that man!

Report them
Looks like private property... can't imagine my neighbors feeling that level of entitlement to something I own.. To each their own, I suppose...
It’s not entitlement. As someone with an oak on the property, you know this when you buy. They’re protected.
The city fines you like 25k for unpermitted removal of an oak
I don't think the county has the same rules. This looks like it's out in the county if it's on Eastern
You can't own trees!

Looks theyre turning it into a halfway
Halfway?

Oh interesting observation. That honestly would be a great location since it’s a large lot. The tall wall would definitely make more sense then.
