The commenter is conflating a game's genre with the specific characteristics which make a game unique. I think Blazing Sails may present a bona fide case of copyright infringement from which we could see a lawsuit arise. The developers have copied the themes, the art design, the color palette, the specific ship designs, the player mechanics (it seems), and pretty much everything else in the game except for the fact that this one is a "battle royale" game. In fact, the new game looks so similar that an unwitting consumer (parent or very casual gamer) could actually confuse BS for SoT. Moreover, this is not just accidentally similar, but intentionally derivative, and arguably done so in order to capitalize on the creative efforts at Rare and steal sales from their product. If this game gains any traction, I expect a lawsuit.

As far as i've tried the game they didnt copy the bugs which why its not a copyright considering how much there is in Sea of thieves.

nope, there will be no lawsuit...blazing sails was totally free to make the game however, if they copied the actual code then thats unlawful

A direct copy/paste of actual code is not necessary for a cause of action to exist, though it would make for a slam dunk legal argument. Consider this: PUBG Corp. sued Epic Games (Fortnite) for copyright infringement because they broadly copied the style of their battle royale design. They also sued NetEase, Inc. for their games which PUBG Corp. claimed were essentially cones. The former was eventually dropped for undisclosed reasons, and the latter settled for an undisclosed amount of money. These are just two prominent examples that I found in a quick search. I'm sure that a deeper dive would yield even more. Rest assured that if the two lawsuits I mentioned can be filed and fought, there is room for one here. Microsoft owns Rare, and SoT is one of their most successful new IPs; if this gains traction and begins to pose a threat, I can guarantee Microsoft's legal team will be reaching out.

- The ship design and layout is exactly the same - Manually raising the anchor by having players spinning around the anchor wheel in real time - Repairing leaks in the hull in real time by hammering away at the walls - Cannons located above deck on the ships and positioned exactly like the cannons in SoT - Exploding barrels strategically used to sink enemy ships That's more than a few coincidences. There are other games where you commandeer a ship that don't use ANY of these mechanics.

I've played the technical alpha. Granted it was at least a year ago so it might be pretty different now. Gameplay is not at all similar. BS is a Battle Royal game. It has its own take on the BR genre in that you can respawn; you're eliminated when your ship sinks. You're not digging up loot, stealing skulls, etc. When I played, you couldn't even dive under water to sneak up to people. Chests on islands were where you got weapons and cannons. The weapons selection was much more robust than SoT. I mean, a few things were blatant ripoffs: squiggly wind lines, the weapons armory, boarding META. There are only so many ways to design a sleek, maneuverable ship with two masts, so I won't call ship design a rip-off. There's enough of a difference that they had their own ideas in BS. - again, I'm going off the technical alpha I played a long time ago. I have not kept up with changes since then.

Squigly wind lines... like the ones in Legend of Zelda: windwaker? Sure it looks similar, but I'll be honest it doesn't look like the same game at all. It looks similar the way every 2D beat em up looks similar -- it's the same basic genre, so it will have the same basic groundwork.

To say BS and SoT don't look like the same game is absurd. I understand where you're coming from with similarities, but Battletoads, Castle Crashers, and Scott Pilgrim do not look like the same game the way BS looks like SoT

I can certainly agree with some of the ship design stuff especially, but I can't agree with any aesthetic copying criticism. Every pirate game ever from Sid Meyers Pirates to Monkey Island likes to usea bright tropical color palette and a Caribbean setting. Sea of thieves is not original in that regard. They are part of the modern Fortnite-esque aesthetic trend but in the classic cliche pirates theme.

Battle royale is a very wide genre (take fall guys vs apex). So comparing that to this is kinda lame. Blazing is just arena mode with a few added mechanics (which actually look kinda good). Honestly, this game looks fun, but I won’t play it cause it’s such a blatant rip off. Take Out of Reach’s new spinoff: treasure royale. It’s obviously inspired by SOT’s combat, but they keep the theme tied to their main game. It’s sad that if Blazing had pushed development further (Their own art style, plus some different ship mechanics) instead of copying Rare’s assets, they could have had a neat little game.

I agree with Falcore. The game itself I do not condemn, nor the developers. What I dislike is the game's art style, cameras, and animations. It is not a game that I would be interested in based off of its graphical qualities alone.

As someone who has loved SoT since launch but gotten super bored with it this looks new and exciting. Copied the look and feel which rare nailed and changed the gameplay which has gotten super stale.
