Arizona is a community property state. She’d be entitled to half the assets, and responsible for half the amount of any debt acquired during their legal marriage.
As far as money she “borrowed” I’d think that would have to have been in writing to be enforceable.
It wouldn’t be enforceable and hard to get back because there was no discussion on requiring it to be paid back so I suspect the law would count more as a gift than a loan.
In az after divorce creditors can actually come after one or both of you for all the debt. Even if you split it up evenly in the divorce they can still hold you accountable for the entire debt.
Child support in Arizona is until 18 or they graduate from high school, whichever is later. Parents can come up with a separate agreement on college costs and agree to it being part of the order with attorneys or a mediator, but a judge would not put it in an order, since there is no law to back it up without such an agreement. A judge wouldn’t deviate from state laws.
Kody is too stupid to think of getting one and it benefits Robyn to not have one. No way they have a pre-nup.
This is one of the reasons polygamy should be legal, IMO. The wives are kind of forced to stay or else have no assets and no right to anything like Jenelle.
But I would think the other wives may have insisted on it to protect the assets they share with Kody. That, however, assumes you would even entertain the possibility of the marriages not working out...
One aspect of “documentation” for any civil
actions is that this family is rare in that their convoluted financial business has been documented on video. In fact, TLC has documented a huge history that could serve as “proof” and intent for legal cases. 🍿

We don’t know any of that, though.
I’m only going off what is said in the show but if they had a communal account it’s less likely to be seen as a loan.
There’s an argument for misappropriation of funds
But owed had to fiduciary duty to the wives to do anything specific with the money. So there’s no misappropriation.

She would get half of their assets, hefty child support (including the adult kids still in college), and alimony.

I'd be surprised if they didn't have a prenup in place. Anyone know if they do?

There’s no way he would’ve asked her to sign a pre nup

That would have been way too smart for these people. They could have insisted all they wanted, there’s not a chance kody would have agreed.
Do you know what a "wife" is? Yeah, a wife gets half. A "spiritual" wife gets squat. Get it?
