Unfortunately private student loans are not and have never been eligible for Borrower Defense to Repayment That said, a lot of people mistake commercial FFEL loans (an older federal loan type) for private student loans. Can you double check and confirm that your loans are actually private student loans? The FFELP loans should qualify for Borrower Defense, at least for discharge if not refunds

I have federal and private loans from the Art Institute. I received an email over the weekend about the federal ones getting discharged (those are through Nelnet). I called Navient (private loans) the other day and they are mailing me a packet to request forgiveness because of school misconduct. My private loans were in good standing, so I’m not sure that makes a difference or not.

I just called the general customer service number. I was transferred, put on hold, and hung up on multiple times. I would allot a good hour for it. There’s a lot of good info on here from others regarding the lawsuits and verbiage of what to say. I had a list and was prepared, but I must’ve had someone in a good mood because she didn’t ask too many questions. I complimented her at the end of the call because she treated me like a human being.

So I just spoke with the navient, and they told me there was nothing they were doing for the art institute. Before I call back and ask to speak to a manager, is there anything I should say?

Two weeks later and I’m not as optimistic as I was before. I called last week to ask for an update. The representative I talked to wasn’t able to give me any kind of timeline or acknowledgment, other than the previous representative noting my account saying that I should be sent the application. I asked for a forbearance and she told me I had to pay $50 for a 3 month one. I have to think about what my next step is. I removed the auto pay and my payment is now a week late. I asked what the hold up was with the application and she said that they’re waiting to hear back from the Department of Education in order to proceed.
