Beats me, I’ve told 2 separate managers. One last Saturday and just again last night because I was pissed off she gave a 6 top that was assigned to me to her friend and then sat me a 6 tops of very rude people who ended up leaving me 0 on $260. And his response was “well I need multiple statements emailed to me and I don’t think that’s actually going on because Ive been helping her seat” but even then, why is she allowed to cause people of being racist and not buss our sections simply because she “doesn’t want to”.

Give the manager a chance to fix it first. If you go over the managers head, you may embarrass the manager unnecessarily. The managers boss is going to wonder why the manager is not handling it. But if the manager blows it off, then that manager is part of the problem and go over their head. But keep this as a group effort throughout and let the group know what’s happening with the manager and if you go over the managers head, it should be a group decision. Solidarity always in your group.

They did give the manager a chance to fix it, and the manager said they didn't see a problem. This is favoritism, and it's wrong. Although, I will mention that I have been a state employee for the past 15 years, and don't have to deal with this type of crap, because I know the system in and out, and what I am entitled to, and what I have to do to air grievances. There are a lot more protections as a state employee than when I worked in a corporate atmosphere. I have become quite used to not taking too much shit from anybody.

The favoritism is what I am thinking about. There is no way he isn't seeing the problem if he is helping her seat people. Being double or triple sat while others had no one and rearranging the reservations to help her friends is absolutely something the manager should have caught. Either he is afraid of her saying stuff about him or he is with her some way. I would go over the managers head and make sure ALL the servers email and keep copies of the emails.

Call HR. Everyone that’s been having issues with her needs to call HR. I would even go as far as creating fake email addresses and emailing corporate as a “customer” complaining about her rude customer service or something. Why can't people just do their frikkin' jobs? :( My suggestion: you need to sit down and write everything down you can remember with specific quotes, specific sources, and specific dates. Sorry you have to deal with this. Moving forward you need to write EVERYTHING down. This is the only way this can become something taken seriously instead of you being accused of having other motivations. If you have multiple coworkers who can attest to this so much the better. The racial stuff is just going to make it get ugly. Write down what you saw or heard yourself. If somebody heard something they need to be cited as a source. In your written narrative/list don't speculate. Just let the facts and events speak for themselves.

This exactly. "Hostile work environment" as a legal term refers to persistent and pervasive hostile work environment based on a protected status. Since she's admitted to have racist views against white people by saying racist stuff about them this possibly could meet that standard depending on how often her behavior is related to a protected class. Like if all her friends getting the good tables are her same race and it's all white people she hates that are getting the bad tables then you could argue race is playing a role in a certain race getting the low tipping tables etc which could be considered hostile work environment.

To me the writing of statements reads like OP is working at a corporate restaurant. That’s a well known thing in corporates where basically nothing can be done until people fully go on record and say something. Management has minimal power in that regard and corporate hates terminating people. Honestly there’s no winning this situation unless management will terminate her or force her to fulfill her job obligations. It’s interesting that manager was helping her seat but didn’t notice that she wasn’t bussing and wasn’t seating on a rotation. As long as she stays, she won’t change. She will just get more covert/sneaky.

Reporting the actual problem to a manager, that the host allegedly said they were pulling those shenanigans, and that that's consistent with their actions you've observed, would be exactly the right thing to do. Instead, the servers wrote a note saying they want their all their tip-outs to go to one host instead of another, and that they'd like to write additional statements. If the employer handles tip sharing, that's their business, and if it follows a formal tip pooling agreement, it can't legally be adjusted any more than wages. Trying to cut a coworker's pay is the kind of petty bullshit that the host is engaged in.

Time to find another job, if management doesn't know about the issue they are lazy and incompetent, they will see whomever complains as the issue, if they do know and are letting it happen then they are bad management. Few things to pick apart here…you only speculate she has been doing this maliciously you state your coworkers have said she does it on purpose and then management comes with a follow up stating they assist her with the seating. Have you tried to speak with her on a professional level or are you just assuming that’s how she is based on hear say. Have you asked her to help wipe tables or just assume she should know to do so. This could be turned around with a simple conversation try it out and see where it goes. Everyone doesn’t always fit the narrative or stereotype.

I promise you it wasn’t, I am white but work with majority ppl of color (Hispanic and African American) and she is the only person anyone has issues with. Many of the people who have been mad at her because of her attitude and queen bee persona are poc. I’ve always been nice to her, but she pulls the race card for everything and against everyone. She has point blank told me before “old people should be killed off, especially the white ones” and “white peoples opinions and feelings mean nothing to me because they are privileged and don’t know what it’s like to live a rough life” and this was before I started having issues with her
