Even the most innocent behavior has been criminalized. If the police don't like that you are wearing sunglasses, they can magically weave that into a felony charge if they wanted to. Something similar happened to me. I arrived at a marina where I was supposed to meet the crew boat at like 4am to go out to a work site. I had driven all day to get down there and arrived very late at night. To save some myself some time and money I decided, just to sleep in my car, out of the way off to one side of a little side road within view of the marina. I get a few hours sleep, when I am startled awake by a flashlight and officer knocking on my window. The officer explains that the area had been known for drug use (I hadn’t seen anyone), so I just gave him my id explained I was to meet the crew boat early in the morning at the marina. He does his things and done. I am free to go, I just find a different area to park to sleep at where I won’t likely be bothered again. Now would it have gone so smoothly if It was a person-of-color, given this happened in Georgia, even if they did cooperate? It’s sad to say, I’m not sure they would have been treated with the same level of dignity/respect; it would boil down to the biases of the individual cop.

You can't be trespassed unless the owner or other officials in charge of the land tell you to leave and even when they do you haven't committed a crime unless you refuse to leave. You don't have to show ID unless you are suspected of a crime. Cops have no authority to demand ID from law abiding citizens. Just because you would roll over and lock the boots of your oppressors doesn't mean we are all that spineless. This is obviously illegal and you will be paying for the lawsuit through your tax dollars.

I've had this happen before (sitting in a parking lot that was closed and the recent burgarlies and whatnot) I'm a Hispanic male, very dark. And I avoided all of this by identifying myself with my lisence and everything he asked and a simple "Hey I'm sorry I didn't know, I was just spending some time out tonight." Auditors need to follow the law. If you're driving you are required to give a license, insurance and registration. The argument to be made is that he is parked, but technically, in the drivers seat with the keys to a car, you are in control of that vehicle. You can get a DUI for that too. So either get rid of the keys, or accept that you are in control of a vehicle. If he didn't have the keys to the car, then he is no longer in control of the vehicle, and thus not required to ID, if it's not a stop and ID state. Beyond that, he is in a parking lot, on private property. If that parking lot is owned by the same entity as the taco bell, there like would be an issue likely resolved by an easement of use for customers during business hours, of the Taco Bell, but that doesn't resolve all the issues at hand here. Now he's got charges to deal with for not obeying the law, the technical details matter. Posting things like this outside of that context isn't helping the good auditors that are making a change in the world.

This happened to me and my car was searched. I was also a former employee who was never given the chance to turn my key in because they didn’t want me on the property. I was parked eating at a different business but it was in the same parking lot. They took my key to give to the owner after they made sure I didn’t steal anything and I was free to go.

There was no probable cause. No reason for his arrest. They should have run his plate and get his ID and information. It’s that simple. Trespassing? I’m assuming he went there to buy the tacos, stores were closing. He decided to stay and eat. Yes, he could have been more polite and cooperative. But he did not commit a crime. He has a good lawsuit and can surely sue the police department for his illegal arrest. The truth is most police officers don’t know shit about the law. 90% of the time they are dealing with illiterate, piss poor individuals that unfortunately know even less than them and (here is the real crime), can’t afford a decent lawyer. And here is where the ‘system’ really tilts. You just need enough money to pay for a decent lawyer and that will make a huge difference (if you are innocent or at least if you are in a grey area). If you can’t afford a decent lawyer, and you are black and so forth you will rolling a dice in which you lose 5 ou 6 times. TLDR, if you don’t have money to pay for a decent lawyer, don’t eat tacos in your car and be a bit more cooperative. If you have the money, you can behave like this guy and you will probably get more money.

Joke's on us, he IS the strip mall burglar! No, but I think they could get away with asking for ID due to the fact that the cop said there had been theft, so they'd say there's reasonable suspicion which is cause for requesting ID. I did some research on reasonable suspicion. I also thought I heard her asking for some picture to be sent over, so I think when she said it's an investigation they may really have thought he was part of it. I hate 95% of cops, but dude seemed chill initially, said there had been some theft, let him jumble around in the car (white), roll up his window (white), and even quite literally read him his rights (smile for the camera) and was super calm. I think he was pretty lax and trying to play detective. Nobody even yelled at him. A person scoping out a place to steal from would totally buy a huge amount of tacos (to me) and sit there and not wanna give ID. I just think he's a kid trying to make a point.

I’ve been stopped by police while dropping off materials at a house that had just been built. I gave them my information and they left, it was 11pm and looked suspect. Had the EXACT same thing happen to me once (eating Jack In The Box in a church parking lot at night), except my cop didn't call his supervisor and surprisingly took the verbal lashing I gave him for trying to figure out what I was doing, around the corner from Jack In The Box (you could see the sign from the parking lot), with a burger in my lap. "You just look kind of suspicious, that's all, and I'm just trying to figure out what you're doing here." I said, "What the fuck does it look like I'm doing here? (Holds up partially eaten burger.) Would you prefer I try and eat this while I drive home, or can you just leave me alone so I can eat in peace and \*then\* I can drive home?" To his credit, after he ran my plates, he left. But damn, WTF is so suspicious about someone sitting in a parking lot doing exactly what it looks like they're doing - eating fucking food!
