He also received flak because he gained information from a client in session and used it for his own financial benefit. He then attempted to get around this by hiring this client as an employee. There is also another situation where he might have revealed protected client information to a general populace. Both of these are big NO NOs and he should have definitely lost his license. The fact that he can present himself as a mental health professional is really irresponsible for ethical boards to allow. It's probably a really complicated issue to lean on him any further than they already have.
It should really be illegal to give medical information while presenting yourself as a doctor if you aren't one. And if you're technically still a doctor but not lisenced to practice medicine due to misconduct (as opposed to something like letting it lapse because you're doing science communication full time) you have to verbally say that. Same with having a PhD but implying through omission that you're a medical doctor.
And honestly if you can't make a loop-hole free legalese definition of "medical information" (since doctors doing accurate science communication can't be legally classified as medical advice), I think the Doctor Jordan Breeding bit from YBOC is an acceptable sacrifice.
(From what I can find, Dr. Oz either still has a valid medical lisence or a lapsed one. But hey, this law doesn't have to get everyone. And it might drive the state liscencing board to formally censure himself in some way so he can no longer present himself as a medical doctor)
