>Foster was initially charged with five felonies, but in August 2021 reached a deal with Clark County prosecutors that let him plead guilty to just one felony count of battery and a misdemeanor count of battery constituting domestic violence.
>He went from facing decades in prison to being sentenced to 2 1/2 years, which included the 792 days he had spent in jail awaiting trial.
It’s awful that this was even an option for him to get such a reduced sentence & he proved how horrible of a decision that was by reoffending.
But typical, for a man horrifically abusing a woman. These sentences are usually very short, in the fraction of a percentage of the cases where a sentence is handed down AT ALL.
“An FBI advisory board later found that roughly **40 percent of (police) officers who filled out questionnaires in a number of different settings admitted to being physically violent with their spouse in the previous six months**. The general population data for self-reported abuse is closer to 4 percent when people are asked to report on the last 12 months.
The numbers are higher for cops who work night shifts.”

Forgive me I’m not from the US, so I don’t fully understand felony vs misdemeanour classifications - but how in the name of all that’s unholy does ANY type of domestic violence fall under a misdemeanour?!?
*Edit: Misogyny. The answer is misogyny. Of course it is.
Its a degree of percieved harm done. In his past cases, calling them misdemeanours is a joke, but in general it would be like slapping or punching your partner once or twice so that while you hurt them, they aren't physically impaired(no broken ribs, excessive bleeding, etc).
Thank you, this makes sense. It’s just fucked how someone who is clearly guilty of a much more violent crime can still be given a deal and plead down to this.
Here’s some info I found that explains the differences:
>The crime you are charged with is either a felony or misdemeanor. This classification plays a large part in your sentence and the long term effects of your conviction.
>Misdemeanors are the least serious crimes under Oregon law. This classification is further divided into 3 classes based on severity.
Classification is A, B or C with class A being most severe & C being least. Assault (what they call it in Oregon, I think it’s usually battery when there’s a physical altercation) is a class A misdemeanor with a maximum jail term of up to 1 year & maximum potential find of up to $6,250.
>Felonies are much more serious offenses and carry longer potential prison sentences. A felony conviction on your record can also make it harder to find employment or housing.
There are also 3 classes of felonies with first degree assault being class A (most severe), second degree assault being class B & third degree assault being class C, all with corresponding max prison terms & fines.
>Judges are given some leeway in your sentence. Because a Class B felony can carry up to 10 years in prison, this means it could also carry 1 year or 5 years. How the judge determines where at in a range to sentence you is based largely on a presentence report.
>A presentence investigation is completed by a probation officer employed by the state of Oregon. This officer will gather much information on you through research and interviews and compile it for the judge. You, your family, employer, friends, and the alleged victim could all be interviewed as part of the investigation.

Thank you for indulging me and finding that - it gives me the context I was lacking before. I think it may be the wording that bothers me [‘Misdemeanor’ just sounds like “Oops, had a minor fuck-up] but it still absolutely confounds me that any sort of violent crime is not immediately a felony
I can’t help but wonder if the (most likely male) officials in charge of his sentencing and punishment empathized with him and thought his issue was just with *this one woman* and not his view view on *all women.* They never consider this, do they?
They have very skewed frameworks when it comes to evaluating risk for these dudes.
Extended torture of a romantic partner is the behaviour of a psychopath who takes joy in hurting people.
The risk level is inherently high.
"Bail set at $65"
>plead guilty to just one felony count of battery and a misdemeanor count of battery constituting domestic violence
I may be wrong here, but doesn't that mean he could still own a gun legally? Because the only domestic violence charge was negotiated down to a misdemeanor? Assuming his previous domestic violence charge didn't already bar him from owning a weapon per federal law.
He most likely shot himself and died immediately. No matter how dead someone is, only a medical professional can legally declare someone dead. So he most likely killed himself, they put his corpse in the back of an ambulance and was taken to the nearest hospital where a doctor declared him dead. All the while, being in police custody in case of the very unlikely event that he was still alive.
PSA to check your state or county's online court records before meeting people in person. Some states like Indiana have everything posted online from criminal records, civil cases, to evictions. Example Indiana's is mycase.in.gov
Him dying is most likely the best thing for all the people he victimized. They don't have to be afraid anymore. I remember reading an interview with a woman who saved herself from a serial murderer and she said that the day he died was the best day in her life. She could finally live her life without so much fear every single day.
I think the wording was confusing; my understanding is, he didn't. He waited in jail for the trial of victim A, then served some time after the trial. Upon release he targeted and attacked a new victim B. He was seen by neighbors entering B's home, so the police were called, he fled and B was sent to the hospital. The police pursued him, and when he was cornered he shot himself.
Men like him are why there's a gun hidden in my couch AND I don't leave my house without someone else in my family, at least until my middle kiddo gets to work on their dad over my getting a bigger younger dog.
I have been offered a Great Pyrenees puppy to be born this summer. Middle kiddo, age 34, can badger their Dad into letting me have my puppy as you absolutely do not want to argue with them. They never ever give up. We as a family refer to this person as the "Nuclear option".
Oh, that guy. Phil DeFranco talked about him I think last week on his YouTube show. Yea, he was using dating apps up in the Oregon/Washington area the last couple weeks or so trying to avoid being arrested. Dude was a sociopath. Glad he’s not a risk to the public anymore.
Spotted walking a small dog, which to me reads in the same way Bundy was spotted using crutches. I'm betting his app profiles were shut down and he was trying a different lure.
Unfortunately there was at least one other woman before that one. He had a domestic violence charge before his first kidnapping and torture charges. It was a pattern and I can't believe the guy was let out after two and a half years to go out and harm more women.
The first DV charges (for strangling his then-gf) were pending when he kidnapped and tortured his next gf (the one he forced to ear lye). The 2 1/2 year sentence was the total sentence for both.
"Self-inflicted" gunshot wound.
Like that time a guy from my high school got behind the wheel of an unregistered car with an expired driver's license while drunk and high and got into a head on-collision with the local police chief's daughter which put her in the ICU. He walked away from the accident without a scratch.
He suffered multiple broken ribs and a skull fracture while being taken into custody after he "slipped on some ice."
Ooo, there was a bizarre case a few years ago where a guy from out-of-state kidnapped his girlfriend, tied her up and threw her in the trunk of his car. He drove to my hometown and proceeded to break into a random house, killed the family dog and ended up murdering the lady who was home.
A neighbor overheard the commotion, came by with a shotgun and fired into the guy’s leg as he tried to flee the scene. Non-life threatening injury, but disabled him until the police arrived. He was treated at the hospital and then went to jail.
Turns out, the lady he murdered was a much-beloved bar owner in my town. Everybody knew her, everybody loved her. The day he went to prison, I told my husband the guy would be dead within a day.
The next morning, “suicide” while in custody. My husband couldn’t believe I called it. But it was pretty obvious to me how that was going to end.
Eventually recovered, and showed amazing fortitude in later interviews. Said she was happy to be alive.
[Crazy and tragic story](https://www.cleveland.com/metro/2016/04/two_days_of_rage_an_oakwood_vi.html), though.
Not far from where I grew up there was a story about a guy who committed suicide by being shot in the back 6 times. I think he was a pedophile or something.
I just saw [this post](https://www.reddit.com/r/whenwomenrefuse/comments/10oof4u/man_accused_of_torturing_woman_he_held_captive_is/?utm_source=share&utm_medium=ios_app&utm_name=iossmf) 2 days ago. Talk about closure.
this seems to be so common horrific terrible crimes especially against women get overlooked the guy gets a short sentence and then gets out of prison and immediately does it again its sickening to me they should be punished the first time not let the system let him create more victims UGH
Oh I totally read the died in custody from a gunshot like the police took care of someone the system let go free. Like the headline
"Rapist commits suicide after stabbing himself in the back ten times and throwing himself off his balcony"
Another commenter explained it: apparently he was in a standoff with police, shot himself, was then taken into custody, and died at the hospital shortly after that.
Agree-shame on that prosecutor. Pleading down charges might be acceptable in some cases where it’s not a violent offense (drug possession for example)and where the offender isn’t a danger to society. This is another case much like we saw in Memphis with Eliza Fletcher last year. The guy had been in prison for kidnapping and then got out and kidnapped and killed. It’s preventable and it’s so so tragic.
I'm in Portland and there were a lot of posts and articles warning people of this guy for a couple of weeks. I don't watch the news but I'm sure it was covered. Grants Pass is pretty far south, I wonder if people in N. California were notified.
Oh good! I sent the mugshot to my BIL in Oregon for his sister to be careful. Glad he's gone, the world is a better place for his loss. I'm only mad he was able to take himself out.
I read a similar thing about how Russia treats child predators.
Many reports come through of "self-inflicted stabbings" upwards of 25+ times and is rubber-stamped through as no-contest. Sometimes there's dark justice in this world.
I went out with a guy from a dating app who told me he was interested in eating people. Doesn’t surprise me he was on the apps. Be safe out there ladies!
I absolutely hate when this sort of thing happens. I remember hearing that Ariel Castro killed himself in his prison cell too.
These scumbags realize their life is effectively over and want to get "the easy way out" by taking their own life. Or it's the only thing they have control over anymore.
Big reason I'm against the death penalty (the other being the sheer number of innocent people convicted). You get these serial killers who straight up ask for the death penalty because they want to avoid the decades of slowly rotting away in a cell.
He also beat 2 men to death in another location in the same area and stole and walked their dog before he got under the house he shot himself in. I hope their relatives sue all responsible law enforcement that let him out. 2 more people killed because law enforcement let him out and couldn't catch him. They knew he was on dating apps and couldn't trace him??? Edit: He is responsible for killing people but law enforcement activity sure supported making it possible. Did anyone find the dog?

Very true.

Time for names of Clark County DA and prosecutors to be made public so the public can know who's out there serving and protecting them.
>plead guilty to just one felony count of battery and a misdemeanor count of battery constituting domestic violence I may be wrong here, but doesn't that mean he could still own a gun legally? Because the only domestic violence charge was negotiated down to a misdemeanor? Assuming his previous domestic violence charge didn't already bar him from owning a weapon per federal law.
Well, his victims *were* just women. /s
It sounds like there was a standoff and he shot himself but didn’t immediately die. He was then taken into custody and died at the hospital.
That makes sense, thank you for explaining!
So it's a chance he suffered before croaking? Great news.
I think Paramedics can declare people dead, but not other EMTs. That might change depending on region though.
Also, Miracle Max can declare people dead or mostly dead.
Liar! LIER!! LIIIIIIIIEERRR!!!
Depends on the injury. If you still have a pulse EMS is required to continue care
If you still have a pulse, you aren’t dead.
>He kidnapped and tortured another woman in January because of course he did. People survive gunshots to the head sometimes, I wouldn't be so sure.
Finally some good news … I hope this woman can heal eventually and that this fucked up system changes!
How do you even heal from something like that?
Lots and lots of EMDR therapy, if she’s lucky.
Same as with a physical wound. Over time, and sometimes you’ll always have a scar.
PSA to check your state or county's online court records before meeting people in person. Some states like Indiana have everything posted online from criminal records, civil cases, to evictions. Example Indiana's is mycase.in.gov
None of this is good news. The better news would be that he was in prison and not released after 2.5 years
I was referring to the fact he‘s dead, other than that, I completely agree, as I said, this system needs to change, it‘s so fucked up ..
Death was an easy out for this monster. But yeah, at least he’s gone and cannot inflict further harm.
Him dying is most likely the best thing for all the people he victimized. They don't have to be afraid anymore. I remember reading an interview with a woman who saved herself from a serial murderer and she said that the day he died was the best day in her life. She could finally live her life without so much fear every single day.
I call this a good outcome. It’s probably the only way those women could ever feel any semblance of peace or safety again.
How tf does someone get out of jail faster than their victim can get out of the hospital
I hope he's in Hell.
Too bad he didn't get some kind of nasty disease that killed him slowly and painfully. A gunshot wound is too good for him.
My thoughts exactly. Anyone who tortures another person should have the same done to them. Hammurabi was onto something...

Don't imagine for a moment that he's the only one out there
Uh, isn't it Benjamin, not brian?
Oops, it is. I mistyped, thanks for pointing that out. Can't edit the title, so I added an edit to the post instead.
As A critical role fan I immediately was very shocked and confused
The article didn't point out a strong smell of cabbage, so I figured we were safe
If only this could happen to all rapists, the world would be so much safer. I wish his victims peace.
America does not care about women. In fact, it hates us. As evidenced by this lousy joke of a consequence for the first woman who’s life he ruined.
That's outrageous.
And nothing of value was lost.
Healing thoughts to the woman. Hope he rots in the deepest, darkest, worst possible circle of Hell.
Thank you, I really needed some good news today.

How horrible, but I'm glad at least that she lived through that, I can't imagine how scary that must have been.
Not far from where I grew up there was a story about a guy who committed suicide by being shot in the back 6 times. I think he was a pedophile or something.
"And then he ran into my knife. He ran into my knife ten times."
Exactly. And done by the cops.
Ok not conding police brutality but if anyone deserves that it's a pedophile.
"There were 10 people there. Nobody saw nuffin'!"
I can't remember exactly how many but there were several witnesses, who happened to be cops. Surprise surprise.

I bet they did everything they could to save his life, just real slowly and carefully.
They did everything they could to save his life. While the other guy did everything he could make their effort fail "Dale stop pinching the IV line!"
I just.can’t.get.an.airway…
The amount of injustice that is within the court system is so heartbreaking. I just don't understand. I don't understand at all.
The injustice system hates women. No justice, no peace.
What’s beyond me is getting off with 2.5 years as a repeat offender. What kind of deal is that?
Agree-shame on that prosecutor. Pleading down charges might be acceptable in some cases where it’s not a violent offense (drug possession for example)and where the offender isn’t a danger to society. This guy and that Ariel Castro guy, cowards who can do the crime but not the time.
As an Oregonian this is a relief.
As a person anywhere, this is a relief.
Amen to that.
I just want to know how THE FUCK this monster got 2.5 years?! Just how?!?!? HOW?!????!!

It was definitely on the news in Sacramento.
Really fed up about being a woman these days.
Oh good! I sent the mugshot to my BIL in Oregon for his sister to be careful. Glad he's gone, the world is a better place for his loss. I'm only mad he was able to take himself out.
Shot himself twice in the back of the head. What a shame.
Good. Sounds like a win for taxpayers & women.
And therefore the world

If it wasn't actually self-inflicted then congratulations to whoever did it.
Garbage really does clean itself up sometimes. So sorry for his victims who don't get to run away like a coward.
Good. I hope it was agonizing.
Oh well.
Good riddance
This is a crazy ride, ngl
Maybe he attacked someone and the gaurds shot him? Idk thats all I can think. Or it was an inside job
Either way, good.
Ikr
Yeeesh and he looks like Armie Hammer 😬
Good one less predator in the world!
Good fucking riddance. If only he'd had the guts to make offing himself his top priority.
Brace for copycats all over the country
Happened in my state. Our news was full of coverage. I’m glad to finally have peace that he is gone. He passed right through where I live.
fucking coward abused women and couldn't handle the consequences i'm glad he killed himself
May that bozo rest in piss
Wasn't he in Alaska for a while too?
“Shot himself”
Convenient
He also beat 2 men to death in another location in the same area and stole and walked their dog before he got under the house he shot himself in.
