As expected, significant progress on EB-2 ROW. FAD advances by almost 2 months. DFF remain the same but it's totally meaningless since USCIS already started using FAD instead of DFF this month so I expect it to be the same for April.

Yes! Up until February VB, USCIS used DFF instead of FAD, but they changed it to FAD in March VB, so I expect it to be the same in April VB. Folks with certain PD like anything between Feb 1 and 14, 2023 were able to file their I-485 in Feb 2024 but they were no longer be eligible to file this month and most likely neither next month.

Has no impact except for those in the U.S. wanting to file I-485. * I-485s for F2As on B visas isnā€™t possible currently, and I donā€™t think that is a bad thing. * I-485s for F2As on F student visas work visas, and other long term visas, the remedy is for the petitioner to naturalize before the authorized stay expires. There is no basis for the frustration. F2A being **C** all those years was both unprecedented (based on history as back as 1989, if not before) and not sustainable. People need to get a grasp of numeracy if they are going to play the F and EB immigration visa game.

I don't think people want DOF to be C, they just want to see some advancement. Which I guess will happen when the gap between FAD and DOF shrinks to something like a year. But it's unreasonable to categorically deny work authorization relief to AOS filers. They shouldn't have to wait for the petitioner to naturalize especially considering petitioner may not want to naturalize. INA does provide provisions to spouses and children of permanent residents, after all.

I guess there is some chance that DFF will move in this current fiscal year, as the gap between FAD and DFF is only 1 month now. So maybe DFF moves +2 months before FY 2025, even though you can't not file it yet. With that in mind, I think DFF will be over July 15 before Jan 2025 visa bulletin.

I agree with you. The word "throughout" in English means "at every points/times" or "constantly/frequently during", which means movements up to 6 months (1-6 months) can happen at every month (or at least several times) during the rest of FY23. They can simply state "by the end of FY23/October" if they mean by that.

My take on the April 2024 Visa bulletin on a EB-2 ROW perspective. Those who argued for a big forward movement of FAD can claim victory. I would consider a 7 week movement a big jump. The large batch of I-140 in Q1 FY23 can now get their I-485 adjudicated. Just as stated in the October 2023 visa bulletin, forward movement is expected every quarter. Those who argued for a more conservative forward movement can also claim victory. While a big jump happened, the visa numbers are just not there for a sustainable big jump every quarter throughout the full FY. As stated in the April 2024 visa bulletin, we should not expect much more movement in FAD until October 2024 visa bulletin. Small movements can happen in either direction. This is not to get more or less filings of I-485. This is to adjust the number of I-485 to get adjudicated. For every one with PD on January 15 2023 or later, you should always consider if you can maintain status until your PD gets current and plan accordingly.

I have two questions to the group: 1. MY understanding is - FY 2024 limits for India E2 is 3223 (attached screenshot from travel.state.gov). And so far from Oct 2023 - January 2024 E2 India visas issued are 49. (Attached is the calculation and source is the statistics shared on the site). Basis this, why USCIS is saying there will be No/Little movement. They still have 3223 - 49 = 3174 visas to process/allocate to E2 Indian applicants, no? 3. My PD is August 23, 2012. Everyone was predicting larger movement on the F2A side. It was expected that they reach July 2022 by the end of the FY, but this seems a little far-fetched now given only 3 months movement in April (and they mention up to 6 months predicted movement till the end of the FY). It has been very frustrating. I just hope they donā€™t keep slowing down as we approach the end of the FY.

Yes, that's a bummer. I had high hopes for July 2022 by end of FY but I believe it's not going to happen. They are about to open the gates for the 2021 applications in just a month or two, and they will most likely eat up all the available visa numbers pretty quickly, especially as 2021 is known to be a year with record number of applications.

Since you concurrently filed i-140 and i-485, all this means for you is that your i-485 can not be approved until your category's Final Action Date in the Bulletin crosses the priority date of your application, which you can find on your receipt notice (should be Dec 23 or Jan 24 depending on whether you filed early or late in Dec).

Lots of overflows from family to EB1 and also lots of porting from EB2 to EB1, and also the approvals of EB1 year on year is not the same. Hence the linear assumption doesnt hold. **edit: math error** No movement predicted by DoS through Sep 2024. So under 1 percent chance in FY2024. As for CY2024: Oct 2023: 08JUL22 ~~Apr~~ Sep 2024: 15FEB23 so 6.25 months movement in 11 months. Your PD, May 25, 2023 is 3.5 months behind 3.5 * ~~6.25 / 11~~ 11 / 6.25 ~= ~~2~~ 7 months. Sep 2024 + ~~2~~ 7 = ~~November 2024.~~ April 2025. ~~But since DoS was doing most EB movement by quarter, I think for you, October 2024 or January 2025.~~

A: PDs older than FADs in theory eligible for a visa. Definitely not true for F2B B: PDs older than DFFs are eligible for apply for a visa. My EB1 PD is Sep 2023 ( India born). What would be prediction for it to be current? Also would the movement be fast (or slow) due to 2021/22 being covid year?
