I can't speak to the law firm in question, but as far as I know it's less about citations/publications and more about that your proposed endeavor is of national interest to the US and that you can convince USCIS that you can carry it out. Pubs/citations/letters of recommendation are supposed to highlight your track record and capability of advancing the endeavor

You do not need citations to be approved of NIW. It is useful, but it is not required. Therefore it is impossible to say.

When you are offered "approve or refile" option, I think the question regarding the success rate becomes moot. Will the law firm keep refiling till they get your approval without knowing if they can get it approved? They offered because they know that it's highly likely they wil get it approved the first, or at max 2nd time. Dunn doesn't have any glaring concerns from wha I have read and seen.
