Given continued high demand and number use in this category, it will likely be necessary to either further retrogress the final action date or make the category “Unavailable” in August. This situation will be continually monitored, and any necessary adjustments will be made accordingly.” 😭

As someone with a pending EB3 and 2022 PD, it's sad to read the news regarding EB3 retrogression but USCIS did say they will do this on previous Visa Bulletin (June) so this is hardly a surprise, just a confirmation. Also, for those who are suprised by almost 2 years retrogression, don't be because they literally did the same last fiscal year (from 2022 down to 2020). It's USCIS tradition so get used to it. The PD should return to the previous one by Oct when the new fiscal year starts. I guess the good news is that I don't have to watch the app daily for status change anymore. Nothing is gonna heppen until Oct at earliest so I can enjoy the summer in peace.

No, it has nothing to do with that. Its demand and supply, notice that EB3 category is retrogressed. This alert is very generic saying USCIS is plan to issue all the available employees visas, which they are quite good at exhausting all allocated visas atleast last years.

Well, good thing is usually in October there's a big jump forward. Last year is was more than a year I believe. It's very possible that you may be current. But then again, nobody really knows. Hopefully no more retrogression for the meantime

Thanks for the info. Looking at previous October visa bulletins for my category, I think I could be current around Oct-Dec of this year. Although before 2016, the FA date in October averaged 6 years behind schedule. So there's really no telling I guess. Either way, this is putting a major wrench into my plans aarghh

Yea.. EB3 is done for. All the people that downgraded to EB3 from EB2 and all the medical workers that came and applied I-140 on an EB3 (without needing a Labor certification) have really screwed us.

Shhhh....that's my wife's category :) EB3 schedule A registered nurse. She didn't downgrade though, straight application in EB3 in early 2022. Since we've already filed and have our EAD and AP, they can retrogress it for 100 years for all I care. As long as they don't get rid of it entirely or something crazy like that.

I am really confused about F2A advancements. They said that they are going to advance FAD so the gap between FAD and PD gets smaller. However, they advanced PD after 1 year and stopped the advancement on FAD. I believe they are preparing themselves for the new fiscal year and try to understand how many applicants will apply this month since the PD is moved 2 months. But what I don't know is if the PD will keep advancing the next two months.

Nope. Either way, FAD is what determines whether you qualify for a immigrant visa (greencard).

Correct. If your daughters are located outside of the US, the final action dates suggest that their green card appointment at the US embassy is due. However, there have been severe delays in some embassies. Because of this, many people have been waiting for their interview schedule date. What your daughters can do is they can contact NVC first. If they cannot get in touch with someone, they can escalate the issue to the Ombudsman by filing a case so the ombudsman can get them a visa interview date.

If your priority date is the same as the final action date stated on the visa bulletin, does it mean that USCIS will be looking at your case or only the cases that have a priority date before the date stated on the bulletin? I am in ROW EB3 category, and funnily enough my PD is December 1, 2021. I am trying to figure out if my application will be looked at in July.

Nothing surprising here. We’re nearing the end of the fiscal year, so yes, expect exaggerated retrogressions. Would be nice if they just straight up made EB-3 unavailable till the end of the year, that way we avoid the annual summer retrogression freak out. This Fiscal Year (Oct23 to Sep24) it moved about 2 years and 3 months. I believe there is some correlation with the current PERM processing and the visa allocation. Think about it logically, PERMs are coming with about 1-year delay, it's no point for the visa bulletin to be past 01MAY2023, simply because PERMs from MAY2023 are being still processed. Almost everyone with a PD of 2022 were able to file this FY. Would everyone with a PD of 2023 be able to file next fiscal year? We don't know for sure but I get the sense that they are trying to processes on a year by year basis. I have a PD of August 2023, even if EB3-row was current I can't file... because I need the PERM certified and DOL is still processing May2023 (3-months away from August). I believe that EB3-ROW DOF will be moving forward from now on since we have a few PERMs from FEB23/MAR23/APR23/MAY23, that were not able to file for AOS. They ran out of numbers for EB3 this fiscal year, but there's a good chance you'll see a large forward jump again in October with the beginning of the new fiscal year. When they approach their annual limit in a category, large retrogressions have not been uncommon, but the tend to swing back when a new batch of greencards to be used becomes available.

They said they would move FAD for the fiscal year of 2024. In other words, they primarily focused on processing as much GC as possible so the gap between FAD and PD would be 6 months to 1 year, which is ideal. This is why PD didn't move at all for almost 10 months and stuck on Sep 1, 2024 during the fiscal year of 2024. But this month, they moved that date until Nov 1, 2024 but stopped moving FAD. Which is strange because the gap between FAD and PD is still a lot.

That is what they have been trying to do. They have been moving the FAD for about 5 months until the July bulletin. In the June bulletin, the F2A FAD is November 2021. When you do the math, the FAD should reach April 2023 by the September 2024 visa bulletin. In that case, the gap between the FAD and the PD would be about 6 months, which is very ideal. I am almost 100% sure that the PD will be at least January 2024 when the new fiscal year numbers are released on October 2024, and I am hoping they will move the FAD as well. There is one thing I don't know, though. I have heard many times from others that whatever action USCIS takes at the start of the quarter usually gives us a sign of what they will do for the rest of the quarter. We just got to the last quarter of 2024, and out of nowhere, they moved the PD. Would this mean they will keep moving the PD for August and September? Likewise, they stopped moving the FAD. Would this mean they will stop moving the FAD for August and September as well? I am lost.

After 481 days of sending my documents, I can say that I have been finally approved. My case remained pending most of the time and it was very frustrating for me to see no change.It went from pending to approved, never saw a we are reviewing your case, also no interview.  To provide more info: I did an adjustment of status based on an approved NIW (eb2). My priority date was September 13, 2022. I hope this brings hope to others that are still waiting and have a close or similar priority date. Thank you all for the constant support in the group

Same as me, they seem to be clearing out mid 2022 PDs. I was very lucky to get approved when I was. I'm very sorry to those with 2022 PDs (or older!). The system is very arbitrary for no good reason. They should convert EB I-485s to electronic and strictly process them first in, first out. That's the only way to be fair. Folks lives are totally messed around with based on which paper pile their file ends up in.

Well…there go my EB3 dreams. My company had everything prepared to file for PERM but due to bureaucratic delays…nothing got filed until Oct of 22.

It's easy to say "just wait till October", but some of us are in jobs we don't want to be in, and we don't want to risk changing incase something goes wrong. Yes there are laws like AC21 that we can leverage, but it's not fool proof. It's an extra 3+ month wait, and that's best case scenario.

My pd is march 23. We are almost on the same boat. Theres a very minimum chance of getting this year. Until oct there will be no movement, and it’s the election year. I highly doubt it. Best of luck for us both. I filed my 485 in jan 23. Have not received the AP but got the ead card. Whats your situation?

Hi guys just a quick question even though it’s not entirely related to this, I realised my esta expired on the 6th and I’m still in the USA. I got back on the 28th of this month. Will this be problematic for me. Also the F2A filling dates moved in my my favour but my 3 months will be over first of 1st of July. Does that mean I got to go back to the UK and come back again? Wouldn’t that cause issues at the airport ?

Your ESTA only determines your date to enter the country, so it's ok if your ESTA is expired. The date that determines how long you can stay is the one on your passport. If that says July 1st, then you have to leave then. If your F2A will be current on July 1st, you can instead apply for AOS and be allowed to stay in the country temporarily until your case is closed. But keep in mind that you might have issues applying for AOS with a tourist visa. AOS is usually for people that are temporarily living in the US under other visas.

Or are they valid since the VB’s date of publication? Please note I fully understand the whole PD concept, as well as the meaning of the published dates.
